8.8 Variances and Anneals. <br />A. Purpose of Provisions. The purpose of this Section is to provide a means of <br />varying the provisions of this Section within its general purpose and intent, <br />based oa prescribed standazds, and to consider appeals of administrative <br />determinations made in enforcing the provisions of this Section. The Board <br />of County Commissioners (the `Boazd' shall heaz and decide appeals of <br />determinations made by an administrative official'chazged with <br />enforcement of this Section and may authorize variances from the strict <br />application of the provisions of this Section, including administrative <br />variance requests refesed by the County Planner. <br />B. Administrative Variance. The County Planner shall have administrative <br />authority to consider and approve sign permit variances only in those <br />instances involving setback distance, square footage, height and size where <br />said measurement will not exceed, by more than ten (10) percent, the <br />maximum allowable limit specified within this Section In addition, front <br />yard setback variances involving "For Sale" and "Open House" signs may <br />exceed the ma~dmum allowable limit incases where maintaining the proper <br />setback distance would render the sign illegible due to the physical <br />constraints found along the entire frontage of the lot. No variance may be <br />approved unless the variance application is complete and the request has <br />been found to be consistent with all of the sign variance review standazds <br />specified below. No administrative variance approval shall be is effect <br />until the County Planner's decision has been referred to and ratified by the <br />Board. The County Planner may refer any administrative variance request <br />directly to the Boazd for full hearing and determination <br />C. Appeals of Administrative Detarm;nations. It shaft be the responsibility of <br />the County Planner to review sign designs submitted for a permit to <br />determine consistency with the provisions of this Section. Decisions made <br />by the County Planner concerning the interpretation or administration of <br />this Section shall be the final action required unless an appeal is filed <br />pursuant to this subparagraph. An appeal may either request a <br />reconsideration bythe County Planner based upon new information, or that <br />the decision be affirmed or reversed by the Boazd, who shall servo as the <br />appellate review authority. The procedure to appeal the Cou~y Planner's <br />decision shall be as follows: <br />1. The applicant or any other party in interest may appeal a decision of the <br />County Planner provided that said appeal is filed with the County Building <br />and Zoning Department within fifteen (15) days after the decision of the <br />County Planner. The notice of appeal shall be in writing, state the grounds <br />of the appeal and include all written material and evidence of consequence <br />to the deternmination of the appeal under consideration <br />Gilpin County Zoning Regulations 55 <br />
