IID. Home-based Businesses Signs. One (1) non illuminated wall sign or one (1) <br />non-illuminated free-standing sign, not to exceed six (6) square feet in size, <br />maybe erected on the same lot with any dwelling identifying the home-based <br />business located therein. The freestanding sign shall be located adjacent to <br />the residence or driveway at least ten (10) feet from the edge of the traveled <br />portion of the adjacent roadway. <br />g.7 ILegal Flom-Comformaime Sflens. <br />A. Definition. A legal non-conforming sign is ~a sign which was lawfully <br />pemutted, erected and maintained prior to the effective date of this sign code, or <br />amendments thereto, and which does not conform to all of the applicable <br />provisions set forth herein. <br />A. Continuance. Any sign that has been determined to be iegal non <br />conforming may continue in use subject to the restrictions and ]imitations <br />specified below. <br />B. Temvmation. The use or operation of a legal non conforming sign shall be <br />terminated as follows: <br />a. By Obsolescence. A sign becomes obsolete with the discontinuance of <br />the business, service or activity which it advertises, or with removal of <br />the business or activity from the location to which the sign directs or for <br />other siurilaz reasons. However, this provision shall not apply to <br />seasonal closings, provided there is a clear intent to continue operation <br />of the business. A sign determined by the Coturty Plazmer to be <br />obsolete shall be removed within thirty (30) days unless an extension of <br />time is granted upon good cause being shown for such extension. <br />b. By Destmclion. Dama¢e or Alteration. The right to continue use or <br />operation of gay legal non-conforming sign shall terminate whenever <br />the sign is altered in any way, or damaged or destroyed over fifty (50) <br />percent, or if the sign is taken out of service for any period of time. <br />c. By Amordzafion. The right to continue to use or operate a legal aon- <br />confarming sign shall terminate five years after the effective date of this <br />Sign Code. However, the amortization period shall cease immediately <br />if the non-conforming sign is otherwise tenninated, and the non- <br />conforming sign shall be removed within thirty (30) days of said <br />termination. Signs located within six hundred sixty (660} feet of a <br />federal-aid state highway which have been determined by the state to be <br />legal "non-conforming advefising devices" or "grand-fathered signs" in <br />accordance with the Colorado Outdoor Advertising Act shall not be <br />subject to amortization ifpre-erupted by said Act. <br />Gilpin County Zoning Regulations 54 <br />
