2.4 Setbacks <br />A setback is the distance from a lot line to a structure, measured at right angles to the lot <br />line. Setback requirements shall apply to buildings, structures and other improvements <br />requiring a building pewit. <br />A. Front Setback, The front setback is the distance between a structure and the <br />principal road adjacent to the lot. Any lot located at the comer of two state, <br />county or private roads shall be considered to have two front setbacks; one <br />adjacent to each road. <br />1. Arterials. For lots zoned R-1, R 2, or R-3 fronting on arterial roads as <br />defined in the Gilpin County Master Plan, including State Highways 119, <br />72 and 46, the front setback shall be not less than one hundred and twenty <br />(120) feet from the center line of the roadway. <br />2. Collectors. For lots zoned R-1, R-2, or R-3 &ontuig on collector roads <br />as defined in the Gilpin County Master Plan, such as South Beaver Creek <br />and Apex, the front setback shall not be Less than thirty (30) feet from the <br />lot line or sixty (60) feet from the center line of the roadway, whichever is <br />greater. <br />3. Locals. For lots zoned R-1, R-2, or R-3 $onting on a platted local road <br />as defined in the Gilpin County Master Plan, the front setback shall not be <br />less than 30' from the Iot line. In cases where a lot fronts or is bisected by <br />a non-platted local road {public or private) the front yard setback shall not <br />be less than 55' from the center line of the road <br />B. Side and Reaz Setbacks. <br />1. R-E. The side and rest setbacks shall be thirty (30} feet, except when <br />the lot line is adjacent to R-1 or Forestry, in which case the minimum <br />setback shall be one hundred (100) feet. <br />2. R 1. The side and reaz setbacks shall be thirty (30) feet. <br />3. R-2 and R-3. The minimum side and rear setbacks shall be thirty (30) <br />feet except when the lot line is adjacent to land zoned Forestry, R-E or R- <br />1, in which case the minimum setback shall be fifty (50) feet. <br />C. Greater Setbacks Requirod for Certain Uses and Activities. In Residential <br />districts, the min;m~ setback for certain activities and stractures maybe greater <br />than the m;n;mum specified above.
