<br />respectively, of Foidel Creek at a point whence the E; corner of <br />Section 13, Township 4 North, Range 87 West, bears North 3640' <br />East a distance of 1,051 feet, which headgates are the initial <br />point of survey for Eckman Park Reservoir No. 2. <br />(3) Eckman Park Ditches Nos. 4 and 5: The <br />headgate is a combination headgate located at a point whence the <br />S} corner of Section 7, Township 4 North, Range 86 West, bears <br />South 2'50' West, 981 feet. <br />(4) Supplemental or alternate points of diversion <br />for the Eckman Park Ditch Nos. 1, 2, 3, 4 and 5 are as follows: <br />The NW corner of the NE$ NE;, Section 13, <br />Township 5 North, Range 86 West; <br />The SW corner of the NE$, Section 31, <br />Township 5 North, Range 86 West; <br />A point Son feet South of the North line and <br />1200 feet .st of the West line of Section <br />32, Tow' .lp 5 North, Range 86 West. <br />Source: Foidel Creek <br />Appropriation date: June 10, 1905. <br />Amount: 13 1/3 c.f.s. Historical consumptive use <br />has previously been quantified at 80.33 acre feet per year for <br />Eckman Park Ditch Nos. 1, 2, 3, 4, and 5, collectively. <br />Use: 360/937 of the total 80.33 acre feet/year <br />decreed to Eckman Park Ditch Nos. 1-5 is currently decreed for <br />irrigation. A change in use for the remaining 577/937 of the <br />13 1/3 c.f.s. water right from irrigation to commercial, <br />industrial and mining, including but not limited to dust control <br />and related purposes, has been authorized by decree in Case No. <br />W-1186-77. <br />4. Storage Rights and Locations to be Used for <br />Aurnnentation <br />Applicant owns or has an interest in the following <br />water storage rights which will be added to the list described as <br />"Storage Rights" on page 3 of Exhibit A to the original Decree. <br />The water rights described in this application in this paragraph <br />4 and those described as "Storage Rights" on page 3 of Exhibit A <br />to the Original Decree will hereinafter collectively be referred <br />to as "Storage Rights." In accordance with paragraph 14 of the <br />Original Decree, applicant requests that the amount of historical <br />consumptive use of the Ditch Rights be changed to storage and <br />that the places of storage be any or all of the Storage Rights. <br />-6- <br /> <br />
