groundwater monitoring plan prior to any blasting, earthmoving, or excavation activities <br />at the site. The technical revision application must contain plans to install at least one <br />goundwater monitoring well up-gradient and one down-gadient from the proposed <br />quarry. The condition requires baseline monitoring and testing for a variety of elements <br />and conditions. to comply with state law regarding impacts to ground water. <br />25. The weight of the evidence, together with Condition Hl, demonstrates that the Applicant <br />has met the minimum requirements of Rule 3.1.6. <br />26. Issue 7(G), Compliance with haws Governing Injury to Existing Water Rights (Rule <br />3.1.6(1)). The Applicant has agreed to a permit condition recommended by the Division <br />committing the Applicant to comply with the requirements of the Uffice of the State <br />Engineer regarding water supply. Condition #2 requires the Applicant to comply with the <br />Office of the State Engineer's "Response to Reclamation Permit Application <br />Consideration" dated September 15, 2005, which obligates the Applicant to undertake <br />certain steps prior to initiating use of goundwater. <br />27. The weight of the evidence demonstrates that with the addition of proposed Condition #2, <br />the Applicant has met the minimum requirements oCRule 3.1.6(1). <br />28. Issue 7(FI), Compliance with Applicable Groundwater Performance Standards <br />(Rule 3.1.7). The Applicant has committed to complying with Rule 3.1.7. The Applicant <br />has provided the Henn Groundwater Report, which concludes that adverse water quality <br />impacts will not be experienced at nearby, offsite groundwater wells. Further, the <br />Applicant has provided an adequate surface water quality monitoring program which <br />ensures protection of surface water quality, and resulting groundwater quality from <br />infiltration into the fractured bedrock aquifer. The Applicant has also agreed to submit a <br />MMRR Bourd Order, M-2004-067 13 <br />2683 <br />
