groundwater monitoring plan to include baseline data and ongoing groundwater
monitoring if necessary as specified in Condition #1, described below.
29. The Boazd, having considered the evidence concerning potential impacts to the area's
hydrologic balance, and at the recommendation of the Division and with the Applicant's
concurrence, has determined to add Condition # I that requires submittai of a technical
revision containing a groundwater monitoring plan prior to any blasting, earthmoving, or
excavation activities at the site. The technical revision application must contain plans to
install at least one groundwater monitoring well up-gradient and one down-gadient from
the proposed quarry. The condition requires baseline monitoring and testing for a variety
of elements and conditions.
30. With the proposed groundwater monitoring condition, the weight of the evidence
demonstrates that the Applicant has met the minimum requirements of Rule 3.1.7. .
31. Issue 7(I), Description and Expected Impacts to Game and Non-game Resources
(Rule 6.4.8 -Exhibit H). The Applicant contacted both the Colorado Division of
Wildlife ("CDOW") and the United States Fish and Wildlife Service ("Service") to
confirm the presence or absence of endangered or threatened species, or other species of
concem on the site and its vicinity. 'fhe Applicant received no written comments from
the CDOW. The Applicant received a Letter from the Service dated September t 5, 2005
in which the Service recommended measures to be taken to mitigate seasonal impacts and
to conduct biological monitoring. The letter stated that while species of concern are
known to occur in Gilpin County, the Service had no specific knowledge suggesting their
occurrence on or use of the project site. Estella Leopold testified that there was a golden
eagle nest in the area that would be negatively impacted by quarry development and
MMRR Board Order, M-2004-067 i4
2684
