6. Mulch and fertilizer will not be effective in this soil type; they will not be used. <br />7. Moffat County does not anticipate the interception of ground water at this facility. <br />Ifground water is exposed, Moffat County will backfill the excavation so as not <br />expose ground water until a well permit has been obtained for the pit well <br />pursuant to CRS 37-90-137. <br />8. Berms, ditches and settling ponds will be used as necessary to divert surface run- <br />offwater away from the pit areas. <br />9. This reclamation plan includes the flexibility to develop the natural low areas <br />within the excavation area to control local Stormwater. If these low areas collect a <br />substantial amount of water for an extended period of time, Moffat County will <br />notify the landowner of that event and will recommend that they apply to the <br />water court for a water storage right and apply the water to beneficial use. <br />10. Moffat County's main access road and possibly some local roads in the affected <br />area will be developed for the construction, mining and reclamation of this <br />facility. They will be graded and drained, where necessary, however, such roads <br />will not be closed out and reclaimed unless the State Land Board requests it. <br />Moffat County will submit all operation plans, and reclamation plans to the local <br />o, ffice of the State Land Board before beginning such activity. <br />11. Moffat County will use and maintain the existing access road from County Road <br />No. 4 to the south boundary of the Affected Land (as shown in Exhibits A-2 and A- <br />4). Moffat County will not remove the drainage structures, or reclaim the access <br />road unless the State Land Board requests it. Moffat County will consult with the <br />local State Land Board off ce before doing arty development or reclamation on <br />this road. <br />12. As a matter of safety, Moffat County may need to re-locate a portion of the 4W- <br />Drive access trail within the affected area during the mining or reclamation stage <br />of operation (see Exhibit F). <br />13.
