EXHIBIT G -1 <br />Water Information <br />Notice: This Exhibit contains the State Engineer's Conditions for Approval by Cynthia J. <br />Love, dated November 15, 2006; this Exhibit G-1 supersedes Exhibit G. <br />The State Pit No. 38 is centered in the NW 1/4SE1/4 of Section 36, T12N, R95W of the <br />6~' P.M., Moffat County, Colorado on a pazcel of state land known as Tract 38. The <br />Affected Land is relatively flat, but the stonnwater drains generally to the north and west <br />as shown on Exhibit C-3. There are no adjudicated water sources on the proposed <br />permitted area, and there aze no springs, wells or wetlands on the property, or within 200 <br />feet of the proposed affected azea. <br />Moffat County will control stormwater by diverting it away from the natural dry wash <br />channels in the construction areas, and will develop berms, ditches, and settling basins to <br />manage the sediment and to control erosion. This project will not intentionally divert <br />stormwater for beneficial use, or affect the "Waters of the State of Colorado and of <br />United States". Local surface water may settle in the low areas of the excavations, anr~ if <br />such water collects in a substantial way, or if it becomes impounded for a substantial <br />period of time, the operator will notes the landowner of that event, and will recommend <br />that they apply to the water court for a water storage right and apply the water to <br />beneficial use. <br />No ground water was intercepted during the exploration activity, and none is expected <br />during the proposed gravel mining effort. In the event ground water is exposed, Moffat <br />County will backfell the excavation so as not to expose ground water until a well permit <br />has been obtained for the pit well pursuant to CRS 37-90-137. <br />Moffat County will comply with all of the NPDES rules from the Water Quality Control <br />Division at the Colorado Department of Health, where they aze necessary. <br />EXHIBIT G-1 (Water Information) <br />State Pit No. 38 -Moffat County Road Department <br />
