H. HONITORING REQUIREMENTS
6. Phase I THE
• Part I
Page lg of 19
Permit No.: CO-0032751
The Phase i THE performed by the parcoittee shall be in general
accordance with Methods for Arnlatic Toxicity Identification Evaluations,
Phase I Toxicity Characterization Procedures (September 1988) published
by EPA, or in accordance with procedures approved by the Division. If
only one species demonstrated toxicity during accelerated testing, then
that species alone may be used in the Phase I TRE. The permittee has 45
days from the submission of the final report on the preliminary toxicity
investigation to complete the Phase Z TRH and submit a report to the
Division on the results of the study.
If the Phase I THE identifies a probable toxicant and/or a probable
source of toxicity, the permittee shall submit written notification to
that effect to the Division as part of the report. Within 30 days of
completing the Phase I TRE, the permittee shall submit for the
Division's approval a control program to control WET, and shall proceed
to implement such plan within 7 days following approval by the Division.
If the Phase I THE fails to identify a probable toxicant and/or a
probable source of toxicity, the permittee shall notify the Division of
its findings. The Division will determine whether a Phase II THE is
applicable.
If toxicity disappears during the Phase I TRE, the permittee shall
submit written notification to that effect to the Division. The
Division may require the permittee to conduct accelerated testing to
demonstrate the continued absence of toxicity. If no acute toxicity ie
found to exist, the toxicity incident is closed.
7. Phase II THE
Zf a Phase II TAE is required, then the following conditions apply:
A plan for a Phase II THE shall be submitted to the Division by the
permittee within 60 days of notification from the Division that a Phase
II THE will be required. The Phase II TRE, ae submitted to or revised
by the Division, may be incorporated into the permit.
The Phase II THE plan shall include the scope, methods, procedures,
reporting requirements, and schedules. A Phase II TAE may follow either
of two directions, ae appropriate: toxicant treatability studies, or
source identification and control studies. Toxicant treatability studies
are designed to aeseae the feasibility of eliminating WET via addition or
modification of treatment proceaeee at the wastewater treatment facility.
Revised 5/2/89
Doc 1003M
