Within 7 days of becoming aware of the toxicity, the <br />permittee shall then begin accelerated tasting of the discharge with <br />whichever specie^ has proven (through the first instance ct toxicity) <br />to be the moat sensitive. The permittee will continue such testing <br />with one species, once suety week until directed by the Division to do <br />otherwise, but in no case for more than five representative taste. <br />5. Preliminary Toxicity Investieation <br />If directed by the Division, the penoittee shall perform a preliminary <br />toxicity investigation. The permittee will have 15 working day^ from <br />the date of Division notification to complete a preliminary toxicity <br />investigation and submit the result^ to the Division, in writing. The <br />preliminary toxicity investigation may include, but ie not limited <br />to: additional chemical and biological monitoring, examination of <br />pretreatment program records, examination of discharge monitoring <br />reports, evaluation of treatment processes and chemical use, <br />inspection of material storage and transfer areas to determine if a <br />spill may have occurred, and similar procedures. <br />If the preliminary toxicity investigation identifies a probbable <br />toxicant and/or a probable source of toxicity, the permitt~ae shall <br />submit, as part of its final report results, written notification to <br />that effect to the Division. Within 30 days of completing the <br />preliminary toxicity investigation, the permittee shall submit for the <br />Division's approval a control program to control effluent =oxieity, <br />and shall proceed to implement such plan within 7 days fol.Lowing <br />approval by the Division. <br />If no probable explanation for toxicity is identified in tl~a 15-day <br />preliminary toxicity investigation, a Phaee I Toxicity Reduction <br />Evaluation (TRE) ie required. The parmittee shall notify the <br />Division, ae part of its final report, of its intent to proceed with <br />the Phaee I TRE. <br />If toxicity disappears during the preliminary toxicity investigation, <br />the parmittee shall submit written notification to that effect to the <br />Division. The Division may require the pennittee to conduct <br />accelerated testing to demonstrate the continued absence of: toxicity. <br />if no acute toxicity is found to exist, the toxicity incident is <br />closed. <br />Revised 5/2/89 <br />Doc 1003M <br />
