<br />(c) A description of how the Reclamation Plan will be iroplemented to meet each applicable <br />requirement of Section 3.1. <br />(i) The Lessor, in conjunction with the applicant, have agreed that the aggregate extraction and <br />recreation lake reclamation after mining is complete is the highest and best use of this pazcel and will <br />enhance the area when completed. <br />(ii) The results of this application of which this is a part and all of the decisions formulated into it <br />constitutes what the applicant believes is an appropriate and workable Reclamation Plan. <br />3.1.2 Reclaiming substituted land: <br />Reclaiming substituted land is not a consideration of this operation. <br />3.1.3 Time Limit and Phased Reclamation. <br />The operator agrees that all reclamation shall be carried to completion with all reasonable diligence, <br />and each phase shall be completed within five (5) years from the date the operator informs the Board <br />or Office that such phase has commenced. <br />3.1.4 Public Use <br />The operator and Lessor do not propose to allow public use in this mining project while it is in <br />progress. <br />3.1.5 Reclamation Measures -Material Handling <br />(1) Grading shall be carried on so as to create final topography appropriate to the final land <br />use selected as the reclamation plan. <br />(2) When backfilling is part of the plan <br />Any backfilling of the excavated area will consist of the use of excess overburden. There aze no <br />acid-forming or toxic materials that could be leached. <br />(3) All grading will be done in a manner to control erosion and siltation of the affected lands <br />from slides or other damage. If not eliminated, all highwalls, if any, shall be stabilized. <br />This is a level pit site, and grading will not subject any of the area to erosion or siltation. There will <br />be no highwalls or potential slide areas in this operation. <br />E-2 <br />
