40. Rule 6.5 (2) requires an applicant, on asite-specific basis, to provide engineering stability analyses for certain <br />slopes configuration, as they will occur during operation, including, but not limited to embankments. <br />Information for slope stability analyses may include, but would not be limited to, slope angles and <br />configurations, compaction and density, physical characteristics of earthen materials, pore pressure <br />information, slope height, post-placement use of site, and information on structures or facilities that could be <br />adversely affected by slope failure. The Division has been supplied with a letter from the Colorado <br />Geological Survey, which expresses concerns related to the stability of the access road proposed for the site. <br />Please supply the necessary information so that the Division can determine whether the proposed roadway, <br />and the surrounding area, will be stable. <br />Because objections were Sled for this Permit, this matter must be set for a hearing before the Mined Land <br />Reclamation Board. The tentative date for the hearing is November 17, 2005. However, the Division will need to <br />make a recommendation by November 1, 2005 to allow adequate time for procedures required prior to the Board <br />hearing. Please be advised that the Gravel LLC 112(c) Permit Application may be deemed inadequate, and the <br />application may be recommended for denial on November 1, 2005 unless the above mentioned adequacy review <br />items are addressed to the satisfaction of the Division. Responses to these adequacy concems must be received by <br />the Division to allow adequate time for review, or at ]east two weeks prior to the recommendation date. If you <br />feel more time is needed to complete your reply, the Division can grant an extension to the recommendation date. <br />This will be done upon receipt of a written waiver of your right to a recommendation by November 1, 2005 and a <br />decision by November 17, 2005, and a request for additional time. This must be received no later than the <br />deadline date.
