Please supply data indicating whether any threatened or endangered species might be found in this <br />area, such as information acquired from the Colorado Division of Wildlife. <br />Rule 6.4.9 Exhibit I -Soils Information <br />34. Rule 6.4.9 (1) requires the application to identify the general type, thickness and distribution of soil over the <br />affected land. The application contains a breakdown of the soil in the affected area. Some of the area <br />contains a soil type identified as AO-B Tefron Loam, which states that constmction of sanitary facilities pose <br />a potential pollution problem to nearby water. Drainage protection from flooding is usually needed before <br />any building construction is started. In that this area is one proposed as residential for the post-mining land <br />use, please identify whether this area is conducive to the proposed post-mining land use. <br />Rule 6.4.10 Exhibit J -Vegetation Information <br />35. Rule 6.4.10 (1) (a) requires the application to describe the present vegetation types, which include quantitative <br />estimates of cover and height for the principal species in each life-form represented. The applicant has <br />supplied some of this information although the breakdown of species, densities, heights, and percent cover is <br />incomplete. For example, during the pre-operational inspection, sagebrush, not identified in the application, <br />was observed in area E. Please submit a more thorough inventory of vegetation present at the site. <br />36. The applicant states that mature stands of narrow leaf cottonwood and some elm trees are located along the <br />banks of the Florida River, outside of the actual proposed mining area, and that these trees will not be <br />impacted. The mining plan indicates that dewatering will occur in Phase D of the site. It is the Division's <br />experience that a drop in groundwater levels of less than two feet can be fatal to cottonwoods. Please indicate <br />how these trees will be monitored and protected from such impacts. <br />Rule 6.4.12 Exhibit L -Reclamation Costs <br />37. The Division will estimate the cost to reclaim the site once the applicant addresses the concerns noted in this <br />and subsequent letters. The Division will estimate a cost to reclaim the site based on the information <br />submitted in the application and responses to adequacy reviews. <br />Rule 6.4.13 Exhibit M- Other Permits and Licenses <br />38. Rule 6.4.13 requires the application to list the other permits, licenses and approval the Operator/Applicant <br />holds or will be seeking. The exhibit does not specify that storm water permits have or will be sought from <br />the Colorado Department of Health, Water Quality Control Division. Please supply this and other applicable <br />information. <br />Rule 6.4.19 Exhibit S-Permanent Man-Made Structures <br />39. Rule 6.4.19 requires the applicant to provide a notarized agreement between the applicant and the person(s) <br />having an interest in the structure, that the applicant is to provide compensation for any damage to the <br />structure; or provide an appropriate engineering evaluation that demonstrates that such structure shall not be <br />damaged by activities occurring at the mining operation, where the mining operation will adversely affect the <br />stability of any significant, valuable and permanent man-made structure located within two hundred (200) feet <br />if the affected land. Installation of the access road will occur within 200 feet of the Williamson house. Please <br />supply the appropriate agreement or engineering study related to this structure. <br />Rule 6.5 Geotechnical Stability Exhibit <br />
