the applicant determines that a drawdown effect will occur offsite that may impact a current groundwater <br />user, the applicant should explain any mitigation measures to be implemented and trigger points that would <br />cause mitigation measures to be put into effect. The Applicant will also need to establish a baseline for the <br />current groundwater levels through at least 5 quarters of groundwater level measurement. <br />26. Please describe how the drawdown of the pit will impact the structural integrity of the surrounding wells, <br />surface water drainages, activities which rely on groundwater in the vicinity of the site, the wetlands, and the <br />cottonwoods and elms located in the area, and any mitigation measure to be implemented and trigger points <br />that would put mitigation measures into effect. <br />27. The Dashner Ditch is located within the proposed permit boundary. Please explain how the ditch will be <br />impacted by the mining operation and the effects of dewatering in Phase D. <br />28. Rule 6.4.7 (3) & (4) require the applicant to provide an estimate of the project water requirements including <br />flow rates and annual volumes for the development, mining and reclamation phases of the project, and to <br />indicate the projected amount from each source of water to supply the project water requirements for the <br />mining operation and reclamation. The application supplies this information, although it appears that the <br />commercial-use well, for which the applicant intends to apply, will not supply the amount of water projected <br />for the project. Please clarify this discrepancy. Additionally, information regarding water requirements for <br />revegetation is supplied and the source of water for this purpose is identified as existing irrigation water, but <br />the information does not identify how much irrigation water will be available for reclamation. Please supply <br />this information. <br />29. The Division received comments from the Office of the State Engineer (OSE) regarding the application. The <br />letter is enclosed for reference. Please acknowledge the conditions for approval noted by the OSE. <br />30. The site of proposed mining is located adjacent to the Florida River. Although the applicant is proposing a <br />60- foot setback form the river, some of the activity proposed in this application maybe located within the <br />river's floodplain. Please supply data that will identify whether mining activity at the site falls within the <br />floodplain of the river. <br />31. The application states that discharge of storm water into any waterways is not anticipated at this time. <br />Sufficient detention is currently under design. Should the potential discharge of storm water be determined, <br />however, applicantJoperator will apply for and receive an appropriate discharge permit under the Colorado <br />Water Quality Control Act prior to surface disturbance. Please supply the design specifications for storm <br />water detention and indicate the capacity of the proposed detention pond and how it relates to the expected <br />amount of water to be removed from Phase D during dewatering and mining, plus the storm water resulting <br />from a 100-year event. Also, please be aware that a change to the mining plan that includes discharge of <br />water from the site will require a revision to the permit in the form of a technical revision or amendment. <br />Rule 6.4.8 Exhibit H -Wildlife Information <br />32. Rule 6.4.8 (1) requires the application to include a description of the game and non-game resources on and in <br />the vicinity of the application area. The application states that there are no significant wildlife resources <br />within the affected or surrounding properties. Please supply data supporting this statement. The trees located <br />in the area adjacent to the Florida River likely serve as winter roosting areas for bald eagles, and neighbors <br />have indicated that bald eagles have been observed in these trees during winter months. Please supply <br />information from a source, such as the Colorado Division of Wildlife, that specifies whether or not this is a <br />significant wildlife resource. <br />33. Rule 6.4.8 (1) (c) requires the application to state the presence and estimated population of threatened or <br />endangered species form either the federal or state lists.
