light of the post-use residential development. Relative to item 14 in this letter, please indicate the fertilization <br />information in the alternative reclamation plan. <br />20. Rule 6.45 (2) (f) (v) requires a description of the anticipated minimum depth or range of depths for those <br />areas where topsoil will be replaced. The applicant has indicated that topsoil replacement will range in depth <br />from 4 inches to 8 inches. The applicant should be aware that the Division requires a minimum depth of <br />topsoil replacement of 6 inches. Please commit to topsoil replacement of this minimum depth. <br />Rule 6.4.6 Exhibit F- Reclamation Plan Man <br />21. Rule 6.4.6 requires the Reclamation Plan Map to show proposed topography of the area with contour lines of <br />sufficient detail to portray the direction and rate of slope of all reclaimed lands. The submitted map does not <br />reflect the slope of the two graded slopes. Please indicate the proposed final slopes of these areas. Please <br />identify the following features, which appear on the Reclamation Plan Map: the dark outlined, kidney-shaped <br />feature and the dark outlined, elongate feature located west of the pond in area D; the dark outlined, circle <br />located east of the pond. <br />22. The application states that the owner/operator proposes to create apost-use reservoir as part of the residential <br />development. The application further states that the reservoir is shown conceptually on Exhibit C. The <br />feature is actually shown on Exhibit F, and the applicant should be aware that this feature cannot be of a <br />conceptual nature on the map. Please adjust the map to reflect the expected results of reclamation at the site. <br />Also please indicate the acreage of the reclaimed pond. <br />23. Two maps, separate from the Reclamation Plan Map, were submitted with the application, which were <br />referred to as conceptual plans for a commercial and a residential area at the reclaimed site. Please be aware <br />that the Division does not accept conceptual maps or plans. The approved permit will contain directions and <br />diagrams that are conditions of the permit and that must be followed to remain in compliance with the permit. <br />Therefore, please clarify the relevance of these maps. Additionally, the conceptual commercial area map <br />appears to contain structures and features that are related to the mining activity at the site. These items, <br />however, do not appear on Exhibit C -Pre-Mining and Mine Plan Map. If these features are related to the <br />mining operations at the site, they must be included on exhibit C and addressed in the Mining Plan. If these <br />features are to remain after reclamation is complete, they must be included on exhibit F -Reclamation Map. <br />Rule 6.4.7 Exhibit G -Water Information <br />24. The applicant should be aware that Rule 3.1.6 (1) of the Construction Material Rules and Regulations requires <br />that disturbances to the prevailing hydrologic balance of the affected land and to the surrounding area and to <br />the quantity and quality of water in surface and groundwater systems both during and after the mining <br />operation and during reclamation shall be minimized. In that the proposed operation includes dewatering of <br />Phase D, the potential for impacts to groundwater exists. Please indicate how impacts to the hydrologic <br />balance of groundwater in and around the permit site will be minimized and monitored. <br />25. Rule 6.4.7(1) requires the operator to directly state if surface water or groundwater will be affected by the <br />mining operation. Again, based on the proposal to dewater Phase D, clearly the operator will be affecting <br />groundwater and possibly surface water. Relative to Rule 6.4.7 (2) (a), please locate on the map (in exhibit <br />C) tributary water courses, wells, springs, stockwater ponds, reservoirs, and ditches on the affected land and <br />on adjacent land where such structures may be affected by the proposed mining operation. Also be aware that <br />wetlands at the site must be delineated to determine whether any wetlands at the site are jurisdictional. In <br />accordance with Rule 6.4.7(2)(b), the Division requests that the applicant identify and characterize the aquifer <br />to be mined in or through. The Division also requests that the applicant define or predict the cone of <br />depression expected for any areas to be dewatered. The cone of depression and assessment of other effects <br />should define, at a minimum, the horizontal and vertical extent of expected impacts. If during the assessment, <br />
