11. Rule 6.4.4 (c) states that the Mine Plan should describe all water diversions and impoundments. The <br />submitted Mine Plan does not contain this information, despite the fact that dewatering is anticipated in Phase <br />D. Please include this information in the Mine Plan and on the Pre-Mining and Mine Plan Map (Exhibit C). <br />12. Rule 6.4.4 (d) requires the applicant to specify the size of area(s) to be worked at any one time. The <br />submitted Mine Plan states that, "It is the intent of the operator to mine an area within each phase not to <br />exceed ten acres at any given time." Please be aware that inclusion of this statement limits the mining <br />disturbance in the permit to no more than ten acres at any given time. If this is not suitable for the Operator, <br />please specify if more than ten acres of mining disturbance will occur at the site at anytime during the life of <br />the permit. <br />Rule 6.4.5 Exhibit E- Reclamation Plan <br />13. Rule 6.4.5 (2) (a) states, in part, that the reclamation plan should include a general discussion of methods of <br />reclamation as related to the mechanics of earthmoving. Please further explain the reclamation plan for the <br />detention pond and dewatering trenches proposed for the mining operation. <br />14. Rule 6.45 (2) (b) indicates that the reclamation plan should include a comparison of the proposed post- <br />mining land use to other land uses in the vicinity and to adopted state and local land use plans and programs. <br />In those instances where the post-mining land use is for industrial, residential, or commercial purposes and <br />such use is not reasonably assured, a plan for revegetation shall be submitted. Appropriate evidence <br />supporting such reasonable assurance shall be submitted. The submitted application states that the post- <br />mining land use is a mix of residential and commercial. Please either submit appropriate evidence supporting <br />reasonable assurance of such post-mining land use or submit an alternative reclamation plan resulting in <br />revegetation of the site. <br />15. Rule 6.4.5 (2) (e) states the reclamation plan should include a plan or schedule indicating how and when <br />reclamation will be implemented. The submitted mining and reclamation plan states that it is the intent of the <br />operator to mine an area within each phase not to exceed ten acres at any given time. Please specify the <br />timing of reclamation of each proposed ten-acre, mined area relative to commencement of mining of a new, <br />ten-acre area. <br />16. Rule 6.4.5 (2) (f) (i) requires the application to specify maximum anticipated slope gradient or expected <br />ranges thereof. The application states that post-mining grading of all affected areas will be performed to meet <br />the topographic requirements of the proposed development. Please describe this proposed grading. Does it <br />conform to the grades depicted in Exhibit F? Additionally, the application states that erosion and siltatien <br />will be controlled throughout the reclamation process such that ]ands outside of the affected area will not be <br />impacted. Please describe how this will be achieved. <br />17. Rule 6.45 (2) (f) (ii) requires the application to specify the types, mixtures, quantities, and expected time(s) <br />of seeding and planting. The submitted application identifies the species to be used in the seed mix for areas <br />A, B, C, and D, but does not identify the ratio. Please supply this information. The application also states <br />that seeding will occur at the appropriate seasonal periods as recommended by area experts. Please determine <br />the appropriate seasonal periods and include this information in the application. <br />18. Rule 3.1.10 (1) states that in those areas where revegetation is part of the reclamation plan, land shall be <br />revegetated in such a way as to establish a diverse, effective, and long-lasting vegetative cover. The <br />application proposes a monocrop of crested wheatgrass for revegetation of area E. Please submit a <br />revegetation plan for area E that fulfills the requirements of this rule. <br />19. Rule 6.45 (2) (fl (iii) requires the application to specify types, mixtures, quantities and time of application of <br />fertilizer. The submitted reclamation plan states that it is not anticipated that fertilization will be required in <br />
