Pursuant to Rule 6.4.4(f-li) and (ii-, please identify the thickness of the deposit to <br />be mined and the stratum immediately beneath the material to be mined. <br />8. The application states that the Dolores River is a warm-water fishery and that <br />discharge temperature regulation is not required. The applicant should either <br />provide adequate information in support of this claim, such as data from the <br />WQCC/WQCD, or remove the statement from the application (not required by the <br />Rulesl. <br />9. Please discuss the potential for flooding to all portions of the permit area and the <br />potential for off-site damage to occur due to the presence of the active pit and <br />after final reclamation. Please clarify the use of the term "spillways" regarding the <br />proposed openings in the material stockpiles temporarily placed along the pit <br />perimeter. Please provide details for the perimeter ditches, rock check dams, and <br />sediment containment silt fence and straw bales, referenced on page 14 of the <br />mine plan. Please show the locations of these structures on the mine plan map. <br />Pursuant to Rule 3.1.6(2) and (3-, please clarify whether the final berms located <br />along the southern end of the south pond, will form an embankment for water <br />impoundment. If the purpose of the final berms is to impound water, please <br />provide additional details of the embankment dimensions, spillwayls) and outflow <br />channel(s-. Please clarify that the final slopes of the permanent berms will not be <br />steeper than 3H:1 V, as indicated on page 17 of the application <br />10. Please provide a comparison of the proposed post-mining land use to other land <br />uses in the vicinity and to adopted state and local land use plans and programs, as <br />required by Rule 6.4.5121(b1. <br />11. Pursuant to Rule 6.4.5121(cl, please describe how the reclamation plan will be <br />implemented to meet each applicable requirement of Rule 3.1, including but not <br />limited to the specific requirements of: <br />3.1.5(21, regarding leaching of toxic or acid-forming materials; <br />3.1.5(31, regarding control of erosion and sedimentation of affected lands <br />(from floodingl, to protect areas outside the affected land from damage; <br />3.1.5(5), regarding control of acid-forming or toxic producing materials that <br />have been mined, in a manner that will protect the drainage system from <br />pollution; <br />3.1.5(71, please clarify that the final pond slopes will not exceed the <br />maximum slope requirements of Rule 3.1 .5171; <br />3 <br />
