<br />defined as affected land. Pursuant to Rule 6.4.3(d-, the permit application needs to <br />be amended to include all portions of the proposed mine access road, to be <br />constructed and/or substantially upgraded to support the mining operation and not <br />located within the CDOT right-of-way, within the boundary of affected lands. <br />2. The application appears to indicate that the gravity drain pipe, extending from the <br />southeast corner of the proposed permit area to the Dolores River, already exists. <br />However, the objecting parties have asserted that the application may be in error <br />because the gravity drain pipe may have not yet been installed. Please clarify <br />whether the gravity drain pipe is already in place or is proposed to be installed as <br />part of the mining and reclamation plan. <br />Installation of a 700' long subsurface drain pipe constitutes affected land. <br />Therefore, the application needs to be amended to include all lands disturbed by <br />construction and installation of the gravity drain pipe and associated outflow <br />drainage channel, within the boundary of affected lands. <br />3. The mining plan indicates that access into the pit will be provided by constructing a <br />temporary pit access road. The pit access road will be eliminated by mining but <br />shall be replaced by a 1740' long road during final reclamation. Construction cost <br />for the proposed 1740' road is included in Exhibit L -Reclamation Costs of the <br />application. The proposed 1740' road appears to be constructed to support the <br />mining and reclamation activities. Therefore, pursuant to Rule 1.113) and 6.4.3(d1, <br />the application needs to be amended to include the final road within the boundaries <br />of affected lands. <br />Additionally, please detail how the north end of the 1740' road will cross the North <br />Pond. <br />4. The reclamation plan and maps indicate that three ditches will be constructed from <br />the Home Ditch to the final ponds, to supply water to the ponds. Construction <br />costs for the feeder ditches are included in Exhibit L -Reclamation Costs. <br />However, the three proposed ditches are not included within the boundaries of <br />affected lands. Pursuant to Rule 6.4.31d), the application needs to be amended to <br />include all portions of the proposed ditches within the boundaries of affected lands. <br />5. Pursuant to Rule 6.4.31b) and (g), please submit an Exhibit C, map, which shows <br />the name and location of all creeks, roads, building, oil and gas wells and lines, and <br />power and communication lines of the area of affected land and within 200' of all <br />boundaries of such area. Regarding permanent man-made structures, please show <br />the owner's name, type of structure, and location of all permanent or man-made <br />structures contained on such area. Permanent or man-made structures include but <br />are not limited to fence lines, cabins, the gravity drain pipe located at the southeast <br />corner of the permit area and the irrigation ditch located within 200' of the west <br />permit boundary. <br />2 <br />
