• The submittal date of this report has been changed to March 1, yearly. <br />This change was agreed upon at the Bear Coal Company, Bear No. 3 Mine <br />mid-term review meeting held on July 26, 1985. Refer to Exhibit 15. <br />STIPULATION N0. 7 <br />The permittee will submit, within one month of permit approval, a Golden <br />Eagle Survey Plan for approval by the Division in consultation with the <br />U.S. Fish and Wildlife Service. This plan will describe a survey <br />designed to determine if the known Golden Eagle nest near the Bear No. 3 <br />portal was active in 1982, and whether there are any alternative Golden <br />Eagle nests in the area. The survey will be conducted within one month <br />of permit issuance, and results will be submitted to the Division to <br />determine if a mitigation plan is needed. <br />STATUS <br />Stipulation No. 7 was resolved as of July 8, 1982, and has been <br />incorporated into the permit. See Section 2.04.11 and Exhibit 10. <br />• Response dated May 27, 1982. <br />STIPULATION N0. 8 <br />The Division directs Bear Coal Company to submit, for review and <br />approval by the Division, proposed locations and construction <br />specifications for the three monitor stations to be installed upon the <br />backfilled material at the Bear No. 2 portal area. Immediately <br />following the completion of backfilling and grading of the Bear No. 2 <br />portal area, these three monitoring stations shall be installed as <br />specified and surveyed. Surveying of these stations shall be repeated <br />on a semi-annual basis for a period of two years. Results of the <br />surveying of these stations shall be submitted to the Division within 30 <br />days following completion of the semi-annual survey. If monitoring of <br />the backfilled area detects movement, which the Division determines to <br />represent an indication of imminent hazard, the Bear Coal Company shall <br />expeditiously develop and implement, following the Division's approval, <br />• a plan to mitigate that hazard and to stabilize the backfilled areas. <br />-4- <br />
