<br />STIPULATION N0. 3 <br />Within I month of permit issuance, the permittee will submit to the <br />Division a detailed plan for handling and treating any discharge of <br />water from the underground workings which does not meet the effluent <br />limitations of 4.05.2. The plan will address the measures to be used to <br />prevent or control gravity discharge including conveyance to, <br />maintenance of, and discharge from sumps, sedimentation ponds or a <br />treatment facility on the permit area. <br />STATUS <br />Stipulation No. 3 was resolved as of July 19, 1982, and has been <br />incorporated into the permit. The Colorado Mined Land Reclamation <br />Division accepted response dated May 27, 1982 after clarification was <br />made in response dated July 8, 1982. <br />STIPULATION N0. 4 <br />The applicant will submit to the Division an annual report of inflows, <br />• discharges and consumption of water within the mine. This report is to <br />include a mine workings map showing the location and quantity of <br />inflows; a table keyed to the mine map which shall contain the source <br />(i.e., fault, fractures, etc.), quantity, duration and quality (i.e., <br />pH, electro-conductivity and temperature) of all inflows; a table <br />containing records of water discharged from the mine, consumed in the <br />mine and imported for use within the mine; a discussion of water balance <br />within the mine; and finally, a projection of hydrologic impacts of <br />mining in the upcoming year. <br />STATUS <br />Bear Coal agreed to submit a detailed hydrologic report on water <br />encountered in the mine. The first report was due August, 1982, and <br />yearly thereafter. Response dated July 8, 1982. The submittal date of <br />this report has been changed to March 1. This change was agreed upon at <br />the Bear Coal Company, Bear No. 3 Mine mid-term review meeting held on <br />• July 26, 1985, Exhibit 15. <br />-2- <br />
