• STIPULATIONS AND RESPONSES <br />BEAR N0. 3 <br />STIPULATION N0. 1 <br />prior to sediment pond construction, the permittee will submit to the <br />Division revised pond designs which will insure that runoff storage <br />capacity will not be reduced by ground water draining into the pond at <br />an_y time during the year. Furthermore, the plan will include a proposal <br />for lining the pond, or otherwise preventing the contamination of near <br />surface ground water as a result of percolation through the alluvium. <br />STATUS <br />Stipulation No. 1 was resolved as of July 19, 1982 and has been <br />incorporated into the permit (see Exhibit 11). The Colorado Mined Land <br />Reclamation Division accepted response dated May 27, 1982 after <br />clarification was made in response dated July 8, 1982. <br />• STIPULATION N0. 2 <br />Within one month of permit issuance, the permittee will submit to the <br />Division a revised plan for handling possible flooding of portions of <br />the permit area. The plan will include an evaluation of alternative <br />flood control techniques and potential downstream effects of any flood <br />diversions. Effects of the river channel relocation on flooding in the <br />area will be included in the evaluation. <br />STATUS <br />Stipulation No. 2 was resolved as of July 19, 1982 and has been <br />incorporated into the permit. The Colorado Mined Land Reclamation <br />Division accepted response dated May 27, 1982 after clarification was <br />made in response dated July 8, 1982. <br />Subsequent to this response, and due to flooding that occurred at the <br />Bear No. 3 Mine during the spring runoff in 1984, Bear Coal Company <br />• submitted a revised flood control plan as a technical revision. This <br />flood control plan has been incorporated in the Bear No. 3 Mine permit <br />as Exhibit 19. <br />-1- <br />
