Kenneth
Engineer in Colorado, who is
Geotechnical in Colorado Springs,
F•1r. Jim Pendleton of the Division.
Stipulation No. 11
No. 3 portals have been designed
I.lyers, a Registered Professional
a principal in Rocky Mountain
Colorado, and with guidance from
Several monitoring points will be located at the Bear No. 3 portal
face-up area explained in the report from Rocky Mountain
Geotechnical. Bear Coal Company will periodically survey these
points and submit the results to the Division.
Stipulation No. 12
Miscellaneous solid waste generated at the Bear No. 3 operation
will be collected at various points during the construction and
mining activities. This waste will then be hauled to a landfill
located between Hotchkiss and Paonia, Colorado for disposal. The
Bear Coal Company currently has a working agreement with the
landfill for disposal of all non-coal waste from the mining
operation. All employees will be instructed to place trash,
garbage, used paper, oily rags, etc. into appropriate containers
for disposal in the Delta County landfill. A conscious attempt by
all mine employees will be made so that all non-coal waste are
disposed of properly.
Stipulation No. 13
Due to current market constraints, the Bear Coal Company has not
finalized the exact location for which coal will be hauled from the
mine. Given the current economic hardships, the Bear Coal Company
would like to have the flexibility to move coal to any potential
market through any viable means.
The Bear Coal Company may be moving coal to one of the other
operators' loadout facilities near Somerset, to an independent
loadout in Delta, Colorado, or tc the Colorado Westmoreland loadout
near Paonia.
Because of the uncertainty with the market and the destination of
the coal, the Bear Coal Company would like to request an extension
from the one-month time frame set forth in the findings document to
a six-month time frame following permit issuance. This will allow
the Bear Coal Company to delineate the potential for use of a
definite coal loadout site.
q
A ~ ~ ixa. ~
