Mr. Dan Mathews <br />• t4ay 27, 1982 <br />Stipulation No. 7 <br />Page Six <br />As shown on page 582 of Volume II of the Final West-Central <br />Colorado Coal Environmental Impact Statement prepared by the United <br />States Bureau of Land Management, a golden eagle's nest (eyrie) <br />with status unknown is shown to be located in Section 17. <br />Durino a field survey on t•tay 24, 1982 conducted by tor. Dan t•lathews <br />of the Division, P1r. Craig Springer of the Bear Coal Company, and <br />t•1r. Alan Czarnowsky of ACZ Inc., two golden eagles were sighted to <br />the west of Somerset; however, no eagle eyrie was seen in the <br />cliffs or in the trees on the north-facing or south-facing slopes <br />of the North Fork of the Gunnison River Valley; however, <br />observations of the eyrie were made from the State Highway 133 west <br />of the Town of Somerset. From local knowledge with input from <br />various Federal and Colorado agencies, it is assumed that the <br />golden eagles have been in this area for some time and have not <br />been impacted by mining operations along the North Fork of the <br />Gunnison River or the Town of Somerset. From the initial <br />investigations on May 24, 1982, it appears that the eyrie for the <br />golden eagles could be located along the higher cliffs of Lone Pine <br />• Gulch, or hidden from view in the north-facing cliffs along the <br />North Fork of the Gunnison River. <br />Mr. Dan t•tathews of the Colorado Mined Land <br />will contact representatives from the U.S <br />Service, the Colorado Division of Wildlife, <br />governmental agencies to determine the exact <br />and to verify that mining will not impact <br />eyrie. <br />Stipulation No. 8 <br />Reclamation Division <br />Fish and Wildlife <br />or other appropriate <br />location of an eyrie <br />the eaoles or their <br />The Eear Coal Company will retain a professional engineer to <br />docw.~ent the proctor density to be used in the backfilling of the <br />portals at the Bear tJo. 1 and No. 2 operations. <br />Stipulation tJo. 9 <br />Following backfilling work on the Bear No. 2 portal area, Bear Coal <br />Company ~•~i'll install two monitoring points on the backfill at the <br />Bear No. 2 portal area.
