Dan hlathews <br />• May 27, 1982 <br />Page Five <br />Water pumped from the underground operation will be <br />passed through the drainage and sediment control <br />structures located on the site prior to any discharge <br />into the North Fork of the Gunnison River. <br />When possible, discharge of any underground water will <br />not take place during or innnediately following a mayor <br />precipitation event. By not discharging water at these <br />times, additional stress will not be created on the <br />treatment facilities utilized for surface runoff and <br />control. <br />All water in the disturbed area, whether pumped from the <br />underground operation or caused by excessive <br />precipitation must meet the effluent limitations as set <br />forth by the Coal Regulations of the Colorado Mined Land <br />Reclamation Board and the NPDES permit. The Bear Ccal <br />Company will undertake any and all appropriate actions to <br />meet these effluent limitations. <br />Stipulation No. 4 <br />• The Bear Coal Company <br />the Division. This <br />encompass monitoring <br />winter and spring of <br />Stipulation No. 5 <br />will submit a full year of hydrologic data to <br />submittal will be made in August of 1983 to <br />during the summer and fall of 1982 and the <br />1983. <br />The Bear Coal Company will undertake monthly and quarterly analysis <br />of the shallow groundwater wells. The results of the analysis will <br />be submitted within 30 days after sampling to the Division. <br />Information from the shallow groundwater monitoring wells will be <br />tabulated for submittal during August of 1983 as a yearly report. <br />Based on the results of the year's worth of data, the Bear Coal <br />Company may request a reduction in the sampling intensity and <br />overall analytical requirements. <br />Stipulation No. 6 <br />As stated under Stipulations No. 4 and No. 5, the Bear Coal Company <br />will submit a summary report with an analysis of the annual data of <br />all hydrologic information collected during the summer and fall of <br />1982 and the winter and spring of 1983.
