Dan Mathews <br />t4ay 27, 1982 <br />Page Four <br />Regulated flow in the North Fork of the Gunnison River by <br />the Paonia Reservoir which is located 10 miles upstream <br />of the operation. <br />Reconstruction of the North Fork of the Gunnison River <br />channel near the Bear No. 3 Mine during highway <br />construction by the Colorado Division of Highways to <br />control and/or eliminate the potential for major <br />flooding. <br />One of the primary purposes of the Paonia Reservoir located <br />approximately 10 miles upstream of the Bear No. 3 site was to <br />effect control on the potential for flooding in the North Fork of <br />the Gunnison River Valley. The dam was constructed in 1965 and has <br />served as a major flood control structure ever since that time. On <br />flood level measurements made by the Corps of Engineers and <br />previously submitted to the Division, the effect of the Paonia <br />Reservoir on flood stage levels near the Bear No. 3 operation were <br />not considered; therefore, with the proper use of regulating flow <br />from the Paonia Reservoir, the Corps of Engineers can assure that <br />the flooding downstream will be minimized or eliminated. <br />• Furthermore, during the relocation of the river channel by the <br />Colorado Division of Highways during the reconstruction work for <br />State Highway 133, special attention will be given by the Colorado <br />Division of Highways to reconstructing the channel so that flood <br />potential is minimized or completely eliminated. <br />Stipulation No. 3 <br />As discussed on page 2.~4-29 of the Bear Coal Company permit <br />application, no water has ever been produced from the workings of <br />the old Edwards t•1ine; and, therefore, no problems with water <br />discharging from the Bear No. 3 portals are expected. Nonetheless, <br />the Bear Coal Company will initiate the following steps in the <br />event that water is encountered during the underground operation: <br />Water encountered during the underground operation will <br />be pumped to an underground sump to be used for dust <br />control during the mining operations. <br />If it becomes necessary to discharge water from the <br />underground sump to the surface, a sample will be taken <br />and analyzed according to the parameters required under <br />the NPDES permit. <br />• <br />~^ <br />A ~i ~c lNG. ~~ <br />
