• <br />• <br />Mr. Dan Mathews <br />May 27, 1982 <br />Stipulation No. 14 <br />Page Eight <br />The Bear Coal Company will not push snow from the mine surface <br />facilities beyond the drainage and sediment control structures at <br />the Bear No. 3 site. Inasmuch as possible, snow will be pushed <br />into designated areas as shown on the revised Mine Facilities Map <br />(t4ap 10). Utilizing selected locations for snow disposal will <br />minimize the possibility that snow will be pushed outside the <br />limits of the drainage and sediment control structures. <br />Stipulation No. 15 <br />Bear Coal Company will place two several subsidence monitoring <br />points as above the first panel to be extracted in the Bear No. 3 <br />operations. These stations will be installed during the summer of <br />1982 so that they will be in place prior to any secondary <br />extraction of coal from the underground operation. These points <br />will be surveyed on a semi-annual basis for elevation and <br />coordinates. The results of the survey will be submitted to the <br />Division. <br />Again, it must be stated that approval of Stipulation No. 1 and <br />Stipulation No. 10 be granted as soon as possible so that no delay <br />in the construction for the Bear No. 3 surface facilities will be <br />encountered. As you know, no surface disturbance can be initiated <br />without the construction of a drainage and sediment control plan; <br />and, furthermore, it is imperative that the Bear Coal Company be <br />allowed to initiate construction of the portal face-up stability as <br />soon as practicable in order to meet coal production deadlines. <br />Thank you for your attention to these stipulations. We appreciate <br />your diligence involved in approval of our application. Likewise, <br />I•ir.
