~~ <br />MLRB MINUTES • <br />• <br />Page 5 <br />AGENDA ITEM 17 - HI VALLEY PAVING, File No. 79-176 <br />Staff presentation was made by Reclamation Specialist, Bob Campbell, regarding <br />Board consideration of Formal Hearing for Civil Penalty. Adequacy material <br />requested by the staff was never provided by the operator. <br />It was MOVED that the Attorney General's Office send a letter to the operator <br />indicating that his permit application is not complete due to lack of adequacy <br />material which has previously been requested by the Division staff, and that if <br />these mate;-ials are not provided prior to the September regular meeting of the <br />Board, con:~ideration of appropriate legal action will take place at that meeting. <br />SECONDED acrd PASSED. <br />AGENDA ITEPf 18 - WEST FORK CORPORATION, File No. 80-141 <br />Staff presentation was made by Reclamation Specialist, Bob Campbell, regarding <br />their gravel pit permit application located 15 miles northeast of Pagosa Springs <br />consisting of 9.5 acres. No objections have been received on this operation. <br />The Mineral. County Planning Commission has recommended approval to the the <br />Mineral County Commissioners, although the County Commissioners will not meet <br />until Octot~er 6. Wildlife concerns were expressed regarding peregrine falcon. <br />It was MOVED that the matter of West Fork Corporation, File No. 80-141, be <br />continued to the September meeting of the Board and in the interim, the Division <br />establish more information on the wildlife issues and also the Division find out <br />if there is a zoning issue remaining on the development of Che operation. <br />SECONDED and SECONDED. <br />AGENDA ITEM 23 - J&J GRAVEL COMPANY, No File Number <br />Staff presentation was made by Reclamation Specialist, Bob Campbell, regarding <br />operation of two pits without permits, possible cease and desist. Staf£ presented <br />the Board members with a letter from J & J Gravel Co. which was sent in lieu of a <br />permit application. After considerable discussion, it was decided to postpone the <br />issue until the September Board Meeting until more detailed information can be <br />obtained from the staff. No formal action taken by the Board. <br />AGENDA ITEM 30 - WILLIAM LACKEY & ASSOCIATES, File No. 7 <br />Staff presentation was made by Reclamation Specialist, Jim Herron, regarding <br />a 112 permi= application for an underground coal operation in Rio Blanco County. <br />Staff recommends approval with bond set at $45,465. <br />It was F10VE1) that the Board approve the 112 permit application of William Lackey <br />and Associates, File No. 79-219, with the bond set at $45,465. SECONDED and <br />APPROVED. <br />
