Staff presentation was made by Reclamation Specialist, Marion Paul, regarding an
amendment t:o a 110 limited impact permit. The permit area is being expanded from
1.79 acres to 8.42 acres in response to the need for an adequate sediment control
system, as stipulated in their permit. Staff recommends approval of this amendment
by the Board, with no bond increase. So MOVED, SECONDED and PASSED.

Staff presentation was made by Reclamation Specialist, Bob Campbell, regarding
the Orin R. Spillers gravel operation in La Plata County. Copy of letter of
objection was submitted to the Board together with a copy of Petition of
Protest which had been received by staff. Staff indicated that the application
has been received by the staff but operation was started prior to approval of
application.
It was MOVED_ that the Orin R. Spillers operation, File No. 80-143, be found in
violation of operating a sand and gravel extraction operation without a permit
by virtue of Jim Schmieding's visit to the site in July, 1980, and an immediate
cease and desist be issued on all mining operations on the property and that
consideration for civil penalty be deferred until a subsequent meeting of the
Board. SECDNDED and PASSED.
The operator requested continuance of his permit application. So P10VED with
note that the application as received was deficient with respect to the appropriate
placement of the application at the county office, SECONDED and PASSED.
AGENDA ITEP1 22 - PIONEER SAND COPB?ANY, INC., File No. 80-156
Staff presentation was made by Reclamation Specialist, Bob Campbell, regarding the
Pioneer Sand Company gravel pit operation in E1 Paso County, presenting the Board
with a copy of an objection received by the staff from NBH Land Company, owner of
property nearby and adjacent to the proposed mine. Staff indicated that the E1 Paso
County Planning Commission has recommended approval to the E1 Paso County Commissioners
at their meeting on August 28. After considerable discussion,
It was MOVEI)_ that all of the objections presented are either invalid or have already
been taken care of; the operator does have legal right to enter, the Board does
find that this is a separate operation of less than ten acres, and other issues have
been resolved by the company. SECONDED and PASSED.
It was recommended by the staff that the Board approve the permit application with
bond set at $2,500.
It was MOVED that the Board approve the application of Pioneer Sand Company, File
No. 80-156, with bond set at $2,500 with the condition ti~at the special use permit
is approved by the Board of County Commissioners. SECONDED and PASSED.
