Section 744.12 (b ). <br />• (b) Surface coal mining and reclamation operations shall be conducted <br />to maximize the utilization and conservation of the solid fuel resources <br />being recovered, so that reaffecting lands in the future through surface <br />coal mining can be minimized. However, the requirements of the Mineral <br />Leasing Act of 1920, as amended, (30 USC 181 et. seq.) and the regula- <br />tions adopted thereunder, for maximum economic recovery and diligent <br />development shall not be dimished by the requirement to maximize utili- <br />zation and conservation. <br />The extensive narrative under Part 816 of this application demon- <br />strates compliance with the requirements and performance standards <br />of 30 CFR Subchapter K. In addition, Energy Fuels will comply with <br />all of the terms and conditions of the surface coal mining and <br />reclamation operations permit applied for here as well as the <br />terms, conditions, and stipulations of the Federal Coal Leases <br />which Energy Fuels presently holds. <br />• <br />As indicated throughout the narrative of this application, Energy <br />Fuels will conduct the surface coal mining and reclamation opera- <br />tions described so as to maximize the utilization and conservation <br />of the solid fuel resources being recovered in order to assure that <br />reaffecting lands in the future through surface coal mining can be <br />minimized. Further, Energy Fuels will comply with all applicable <br />requirements of the Mineral Leasing Act of 1920 and the regulations <br />adopted thereunder at 30 CFR 211. Compliance with the regulations <br />at 30 CFR 211 is specifically addressed in a separate section of <br />this application. <br />Section 744.13 Performance standards: Completion of operations <br />and abandonment. <br />(a) Temporary abandonment. Each person who conducts surface coal <br />mining and reclamation operations shall, in areas in which there are no <br />• current operations, comply with 30 CFR 816.131 or 817.131, as appropriate, <br />744-3 <br />
