Section 744.11 (b) Continued. <br />• This subsection is not applicable to Energy Fuels' proposed <br />exploration program since no oil, gas or geothermal resources <br />exist within the mine plan area. No such resources have been <br />encountered during previous coal exploration activities conducted <br />by Energy Fuels within the mine plan and adjacent areas. <br />(c) Use of wells by others. Upon receipt of a written request from the <br />surface owner or the appropriate authorized officer, the Regional <br />Director, in consultation with the Mining Supervisor, may approve the <br />transfer of an exploratory well for further use as a water well. <br />Approval of the well transfer shall be accompanied by a corresponding <br />transfer of responsibility for any Liability for compliance with the <br />Act, this Chapter, damage from use or maintenance of the well and <br />eventual plugging. Nothing in this paragraph shall supersede or affect <br />the applicability of any State law with respect to that transfer. No <br />person engaged in exploration shall be relieved of responsibility for <br />• exploration wells except to the extent set forth in an approval granted <br />under this paragraph. <br />Energy Fuels does not anticipate the transfer of any exploratory <br />well for further use as a water well (see also the discussion under <br />30 CFR 816.53). If a later transfer of use is desired., as des- <br />cribed in 30 CFR 744.11 (e), then that transfer will be conducted <br />in compliance with the requirements of. 30 CFR 744.11 and 816.53. <br />Section 744.12 Performance standards: Mining and reclamation. <br />(a) All surface coal mining and reclamation operations on Federal lands <br />shall be conducted in accordance with the requirements of 30 CFR Sub- <br />chapter K, the terms and conditions of the surface coal mining and <br />reclamation operations permit, and the terms, conditions, and stipula- <br />tions of the lease, license, or permit issued under the Mineral Leasing <br />Act of 1920, as amended (30 USC 181 et seq.) and regulations promulgated <br />• thereunder. <br />744-2 <br />
