This avoids the problem of <br />attempting to permit an area that is already permitted to another <br />operator. <br />2. Please further clarify the status of the adjacent permanent industrial <br />site. To whom is this site permitted as an aggregate processing area? <br />Is it presently used for this purpose, or will it begin to be operated <br />as a result of the material available from the adjacent Caldwell <br />Brothers 3 operation? If this is truly a separately operated <br />industrial site, it does not need to be included as a part of this <br />permit area. However, if it begins operation as an integral part of <br />this 112 permit, it must be included as a part of permit No. M-86-016. <br />Please clarify this matter further. <br />\ ,3. Please make it clear that the "deleted area" of the drainage Swale is <br />/~(\ not, to date, a disturbed area which requires a reclamation plan (and <br />thus, inclusion within the permit area). <br />4. Please more carefully describe the existing disturbance due to both <br />existing permitted operations within the new 112 area. This will allow <br />%\ / us to get a better picture of the full existing disturbance due to <br />/X\ these previous mining operations. The maps requested under Exhibit C, <br />questions 1 and 3 should be helpful in this regard. <br />5. Be advised that it is the responsibility of the operator to make sure <br />that this operation does not cause the movement of sediment into the <br />"deleted area" Swale. Any sediment movement or new erosion in this <br />off-site area due to the mining operation would be in violation of the <br />permit. I am not certain that placement of the haul road as you <br />describe is an adequate sediment and erosion control plan. You may <br />wish to consider using a more organized berm and pond system. Please <br />discuss this matter further. <br />Exhibit E - Reclamation Plan <br />1~ Please describe the condition of the presently-permitted, but <br />undisturbed portion of the permit area. If it will continue to be <br />undisturbed, you should plan to ask for release and delete it from the <br />permit area at some future date. <br />~/2. Please describe the perennial grass seed mixture to be used on the <br />/\ remaining topsoil stockpile (seeding method, rates and species). <br />3. Although I understand that the eventual goal for this permit area is to <br />have only 8 to 10 acres requiring reclamation, the present disturbance <br />%~ for both existing permits must exceed this acreage. Your reclamation <br />plan should describe the presently disturbed area and how it is to be <br />reclaimed and can perhaps discuss an eventual transition to the reduced <br />maximum disturbed area. <br />Exhibit F - Reclamation Plan Map <br />\/ 1.
