Reference my concerns under Exhibit D, question 5 concerning protection <br />of the drainage Swale. <br />Xz. Enclosed, please find a copy of the review letter from the Division of <br />Water Resources. Please verify the operator's compliance with item 2 <br />in that letter. <br />Exhibit I - Soils Information <br />Typically, proposed mining operation permit areas of this size cannot <br />be adequately characterized for reclamation purposes by county soil <br />survey information. In this case, however, your soils data seems <br />adequate fora site of this relative simplicity. <br />Exhibit L - Declamation Costs <br />1. In general, I feel that your costs are in a practical range for the <br />activities you list. However, I note that you have included no final <br />grading, surface preparation costs for the acres involved. Give the <br />typically rough surface left by mining, some costs for final smooth <br />grading are usually included. You should either include these costs or <br />justify their omission. <br />2. Given the two adjacent existing operations, it may be that there would <br />be some added costs beyond your typical costs given for the ongoing <br />operation (e. g., removal of old stockpiles). If this is the case, <br />these costs should be included. <br />3. If 16 acres are now disturbed, and only these 16 acres are to be <br />~ covered by a financial warranty, no expansion (new mining) could occur <br />~~ until some portion of the existing 16 disturbed acres was reclaimed and <br />~ ~` released. I suggest you calculate reclamation costs and submit <br />~, ~~- financial warranty that will cover the existing disturbance and the <br />D ~ planned expansion for at least one year (and preferably, a longer <br />period). <br />Please feel free to call me if you have any questions concerning this letter. <br />Sincerely, <br />~ r~ <br />Mark S.
