~ III IIIIIIIIIIIII III
7398
DEPARTMENT OF NATURAL RESOURCES
Davitl H. Ge[ches, Executive Director
•
MINED LAND RECLAMATION DIl
DAVID C. SHELTO N, Director
Richard D Lamm
G~~f4pril 2, 1986
Mr. Donald A. Rapp
8730 West Mountain Yiew Lane
Littleton, Colorado 80125
Re: Caldwell Brothers - "Caldwell Brothers 3" - File No. M-86-016
~.ay~-:
Dear-N~-ik~p~:
I have completed my adequacy review of the 112 permit application for the
above captioned operation and have several questions and comments which I have
organized on an exhibit-by-exhibit basis below. As always, any exhibit or
part thereof not mentioned is now considered adequate for Board approval
during the scheduled April 23-24, 1986 meeting. Please respond to this letter
at your earliest convenience, but certainly by no later than April 18, 1986.
In this way, I can review your responses and comment, as necessary, prior to
the Board meeting. If we can clarify these few areas of concern, I am sure
that this matter can be considered by the Board in a "no problem" format.
Before the Board can consider this application, we will need to receive the
usual proofs of publication and notification to all immediately adjacent
landowners (including the Colorado Division of Highways). Please send these
items as soon as they are available.
Exhibit C - Pre-Mining and Mining P1 an Map
, 1. As per Rule 2.12(3), please submit a map of the proposed permit area
\Xi that is a topographic map of the site as it now exists. This map
should have contour lines at appropriate intervals to display the
features of the present site.
2. I note that only one topsoil stockpile is portrayed on the mining plan
` / map. Presumably, there will be more such stockpiles. To the extent
X possible, all proposed locations of topsoil stockpiles should be shown
on this map.
3. Please submit a map that shows the boundaries of permit numbers
~, / M-79-007 and M-85-179 which are included within the boundaries of this
/~(\ new permit area. This is needed to assure that these old permit areas
are actually being incorporated into the new permit area and in what
fashion.
Exhibit D - Mining Plan
1. Before our Board can approve the new 112 application, we will need a
written request for release of the financial warranty for permit number
M-85-179 from HLM Construction, Inc. This request should also state
that HLM Construction no longer wishes to keep their 111 permit on the
site and has no objection to Caldwell Brothers permitting the entire
423 Centennial Building, 1313 Sherman Street Denver, Colorado 80203 Tel.
