~~ <br />NOW THEREFORE, Pursuant to the authority set forth in the <br />Colorado Open Mining Land Reclamation Act, the Land Reclamation <br />Board of the State of Colorado has determined that the following <br />land stabilization and reclamation procedures will be followed in <br />the mining operation of Cooley in Sections 10, 11 & 15, TSS, R70W, <br />Jefferson County, Colorado, and Cooley hereby agrees to faithfully <br />perform the land stabilization and reclamation work required herein. <br />1. Cooley will stockpile and retain topsoil wherever <br />possible. <br />2. If Cooley plans to discharge into a waterway, then <br />a permit to discharge into same will be obtained from the <br />Environmental Protection Agency and Cooley will abide by the <br />regulations pertaining thereto or those set by the Colorado Water <br />Quality Control Commission. <br />3. Cooley will control erosion on or along haul roads <br />by the use of drainage ditches, culverts or check dams. <br />4. Blasting will be conducted during daylight hours <br />only and in a manner to alleviate or curtail shock and concussion <br />nuisance by controlling the size of the blast. <br />5. Cooley will monitor fugitive dust resulting from <br />this operation to keep same in compliance with the dust emmission <br />standards set by the Air Pollution Control Commission of the State <br />of Colorado. <br /> <br />6. Cooley will proceed with the plan as outlined in <br />the environmental report within three (3) years after the cessation <br />of operations covered by the permit application. <br />7. Trailers and/or buildings used for office, storage, <br />and maintenance shall meet local zoning regulations. <br />8. Special use or other forms of permits shall be <br />obtained from the county agency authorized to grant such permits. <br />9.
