.._~. <br />10. Natural drainways, or drainways constructed to <br />alleviate flood conditions in the area shall be kept free from <br />overburden, stockpiles and topsoil. <br />11. Cooley will grade and stabilize any surface area <br />disturbed by this operation and revegetate the area, following the <br />best information available from qualified organizations or persons. <br />12. Plan and agreement will be updated annually so that <br />new techniques can be utilized as they are produced or found, <br />13. Land stabilization and reclamation will be maintained <br />for a period of three years after all mining activities cease, and <br />if the property is sold, leased or transferred in any manner, the <br />new owner, lessee or person having control shall agree to be bound <br />to the unexpired period of the three year term. <br />14. Nothing in this agreement shall subrogate the <br />operator's responsibility for compliance with local county zoning <br />reauirements. <br />15. Cooley shall furnish the Land Reclamation Board a <br />performance bond in the amount of S55,000.00 to insure that <br />the work required herein will be accomplished. <br />If any of the terms, conditions and requirements of this <br />agreement are violated at any time during the period of this <br />agreement, the Land Reclamation Board may at their sole discretion <br />close the mining operation until satisfactory arrangements have been <br />made to bring the operation into compliance with this agreement, <br />This agreement shall be binding upon the successors and assigns of <br />the parties hereto. <br />Witness our hands, this 2- ~ day of .~6- 1974. <br />COOLEY GRAVEL COMPANY <br />By <br />Approved: T.
