providing stream channel bufferzones as
required in 4.05.18 and 4.20.4 or restoring
stream channels as required in 4.05.4:
RESPONSE
Since only ephemeral streams are located in the permit and
adjacent areas, no aquatic communities are present.
Consequently, no stream buffer zones are present or
necessary.
4.18. (4)(g) Not use persistent pesticides on the area
during surface mining and reclamatlon
operations, unless approved by the Division:
RESPONSE
H-G Coal Company plans to use Tordan 22K for the control
of Canada thistle (Circium arvense). The herbicide will
be applied by a certified ground applicator licensed in
the State of Colorado at the concentrations prescribed by
the manufacturer. When H-G Coal Company plans to use the
herbicide, specific information and details of the plan
will be supplied to the Division.

of its poet mining land uses in association wlth domestic
grazing.
