4.18 (2) (b) Any critical habitat of any threatened or endangered animal <br />• or plant species listed or proposed to be listed by the State <br />or Secretary; <br />RESPONSE <br />Information from the baseline vegetation and wildlife studies <br />indicate that there is no critical habitat of any threatened or en- <br />dangered animal 'or plant species listed or proposed to be listed <br />by the State or Secretary in the permit area. <br />4.18 (2) (c) Any bald or golden eagle, or nest thereof, of which that <br />person becomes aware and which was not previously re- <br />ported to the Division by that person. _ <br />RESPONSE <br />No bald or golden eagle nesting sites have been found in the <br />permit area. Potential nesting habitat is very limited in the <br />permit area. If a nesting site is located on the permit area it <br />will be reported to the Division. it <br />• 4.18 (3) A person who conducts surface coal mining operations shall <br />ensure that the design and construction of electric power lines and other <br />transmission facilities used for or incidental to the surface coal mining <br />operations, on the permit area are in accordance with the guidelines set <br />forth in Environmental Criteria for Electric Transmission System (USDI, <br />USDA (1970)) , or in alternative guidance manuals approved by the Divi- <br />sion. Distribution lines shall be designed and constructed in accordance <br />with REA Bulleting 6110, Powerline Contacts by Eagles and Other Large <br />Birds, or in alternative guidance manuals approved by the Division. <br />RESPONSE <br />Bulletin 61-10: "Powerline contacts by eagles and other large <br />birds, or in alternative guidance manuals approved by the Divi- <br />sion. " <br />Power for mine shop facilities and related structures was ob- <br />tained from existing powerlines. All powerlines relating to <br />surface mine operations are located underground. Consequently <br />no harm to wildlife can take place. <br />Powerlines at the coal loadout facilities were installed by Yampa <br />. Valley Electric Association and conform to local, State and Fed- <br />eral regulations. - <br />
