The agreement with the Fulton Ditch Company will be <br />submitted when it has been approved. We would ask that the <br />application be approved with the condition that no mining <br />can take place within 200 feet before the final agreement is <br />reached. We ere in the process of negotiations at present <br />end feel that en agreement will be reached soon. In regard <br />to Brighton Road and the drainage ditch, Adams County has <br />reviewed and approved this mining plan. <br />7. The fencing will be removed after mining and reclamation is <br />completed. <br />8. We are not going to use all o£ the overburden and topsoil <br />for land application. A large portion of this will be used <br />as fill in the lake to create more dry land from <br />backfilling. The proposed reclamation will call only for <br />placement of 6 inches on land in anticipation of a future <br />use for homes. Before this future use occurs, the 6 inches <br />placed will be adequate to maintain vegetation. We also <br />point out that the topsoil and overburden in this area are <br />indistinguishable. Either material provides adequate growth <br />medium. <br />9. We concur with item 9 and will incorporate it into the <br />reclamation plan. <br />10. The property will be used for wildlife habitat after the <br />reclamation is completed. <br />11. The operator has devised a mining plan that can make use of <br />existing materials on the property. All salvaged overburden <br />and fines will be used for backfilling the lake to the <br />maximum extent possible. The mining plan wea devised in <br />this manner to remove dependence on outside sources of <br />material. It becomes very expensive to import fill <br />material, and quality control of the material brought in <br />becomes a serious problem with regard to groundwater <br />pollution. Also, it is necessary to have a Certificate of <br />Designation for operating a landfill using outside sources <br />of material. <br />12. As we discussed, the drawdown in this area is o£ no concern <br />and has been addressed. No aquifer testing was done in the <br />area. <br />
