<br />j. No salable minerals, such as sand, gravel, stone, or peat found on the Permit land, shall <br />be removed or used by the Permittee unless purchased from the State Board of Land <br />Commissioners at a price agreed to in writing prior to removal. <br />k. Only the road as permitted shall be used. This Permit does not allow vehicular use off <br />of the designated area. All gates shall be left open or closed, as found. <br />I. This Permit is issued for the purpose specified above and no other. Should the <br />Permittee use or attempt to use the described land for any other purpose, without written <br />permission from the Board of Land Commissioners, the permission herein granted shall <br />terminate at once. <br />m. The State Land Board reserves the right to tern3inate this Permit at any time upor. thirty <br />(30) days notice in the event of the sale, exchange, condemnation or any other <br />disposition of the Permitted Premises. In such event the Permittee shall only be entitled <br />to be compensated for the value of its pemtanent improvements placed on the Permitted <br />property and approved in writing by the State Land Board. In no event shall the State <br />Land Board be liable for the payment of any such compensation to Permittee. Permittee <br />shall not be entitled to receive any compensation for any value of its leasehold interest. <br />n. If this Permit terminates for any reason, Permittee shall have no claim or right to any <br />compensation for any Permit option beyond the two (2) years of this Permit, or for any <br />expectation that the Permit term would be extended or the Permit renewed. <br />4. The Permittee shall execute a good and sufficient bond, in the amount of One Thousand and <br />No/100 Dollars ($1,000.00), with sureties to be approved by the said State Board of Land <br />Commissioners, for the payment of the faithful performance of all the covenants and <br />agreements as provided herein. <br />5. That no assignment of this Permit shall be valid unless it shall have been entered upon <br />records of and approved by the State Board of Land Commissioners and payment of <br />assignment consideration made. Any unapproved assignment of this Permit shall in no way <br />release the Permittee from liability to the grantor. It shall be understood by the Permittee <br />that any name change of the Permittee shall be deemed as an assignment and approval of <br />such name change must be obtained by the Permittor. <br />6. Subleasing al] or any part of the Permitted premises for any purpose during any part of the <br />term of the Permit unless authorized by the State Board of Land Commissioners in writing, <br />shall be cause for cancellation at any time. <br />sUP 93234 Page 3 of 5 <br />
