<br /> <br />b. Clear cutting of vegetation is not authorized except on the portion of the permit area <br />specifically designated here: <br />Timber is not to be cut unless specifically authorized. Any merchantable timber cut on <br />state land by the Permittee is to remain the property of the state. All other timber, <br />slash, stumps and boughs are to be disposed of by the Permittee. <br />c. This Permit does not grant exclusive use of the land described, and the pennit area shall <br />be available for other surface uses, including livestock, grazing. Tfiis Permit is subject <br />to all leases now in effect on said land, and the Permittee is to cooperate with, and not <br />to interfere with, nor prevent the operations of the lessee. In all cases this Permit is <br />subject to any rights-of--way heretofore granted and now in effect. <br />d. The Permittee is to provide drainage and erosion control structures, fences, gates, <br />cattleguards, or any other facilities necessary to protect state land. <br />e. All operations of the Permittee shall be conducted in a workmanlike and reasonable <br />manner, and all necessary precautions shall be taken to avoid and damage to the state <br />land of the property of the lessee. Any damage done to the state's property, native <br />grass, peat, or timber, or other state-owned improvements, shall be paid for to the state. <br />Damage to private property, including fences, crops, irrigation structures, wells, <br />livestock and privately-owned improvements, shall be paid for to the owner thereof. <br />f. To the extent, authorized by law, the Permittee shall indemnify, save and hold harmless <br />the Board of Land Commissioners, its employees and agents, against any and all claims, <br />damages, liability and court awards including costs, expenses and attorney fees incurred <br />as a result of any act or omission by the Pertnittee, or its employees, agents, <br />subcontractors or assignees pursuant to the terms of this Permit. <br />g. This Permit does not grant the use of water from said premises, either from flowing <br />streams or from wells. <br />h. No refuse, waste or litter of any kind shall be left on the land. The Permittee shall <br />comply with all federal, state, and local laws, regulations and standards relating to air, <br />water, land and noise pollution. <br />i. The Permittee shall not permit the storage of or spill any toxic or hazardous material <br />on this site while in its possession. No underground storage facilities are authorized. <br />The Permittee shall be responsible for the clean-up or restoration of this land due to any <br />toxic or hazardous material during its occupancy of this site. <br />SUP 93/234 Page 2 of 5 <br />
