Note 4 on the Reclamation Plan Map indicates that the temporary landscape features will be either removed or <br />maintained at the option of the owner. The Division requests that the operator commit to either removing the features <br />or leaving them in place with adequate vegetation established to provide protection from erosion. Please respond. <br />I5. Please clarify if the office building will remain on site after mining is complete. If the office building is to be <br />removed during reclamation please provide its dimensions and composition in order to accurately estimate a cost for <br />removal in the reclamation bond estimate. Also, if the building is to be removed please revise Exhibit F accordingly. <br />16. The applicant indicates that a pazking lot may be constructed adjacent to the office building. Please to commit to <br />either constructing a parking lot or reclaiming this area. If the operator commits to constructing a pazking lot, please <br />provide the proposed design to include dimensions of the lot and the materials used for its construction. <br />17. Please describe the access road located in the southwest corner of the permit azea that will remain after reclamation. <br />The description should provide the proposed design and include the dimensions of the road and materials used for its <br />construction. <br />I8. The applicant indicates that a utility line will be relocated to run parallel to the west boundary of the permit area. <br />Please indicate which utility line will be relocated and who is responsible for relocating it. <br />Rule 6.4.7 Exhibit G -Water Information <br />19. In accordance with Rule 3.1.6(1)(a), please explain how disturbance to the hydrologic balance will be minimized <br />during the mining and reclamation phase of the Grand River Park Project. Please explain how Silt Sand & Gravel <br />will be in compliance with Colorado Water Laws and regulations governing injury to existing water rights. Please <br />inform the Division as to when a Temporary Substitute Supply Plan (TSSP), Well Permit and Plan of Augmentation <br />will be obtained from the Division of Water resources. The Division received comments from the Office of the State <br />Engineer (OSE) regazding the application. The letter is enclosed for your reference. Please acknowledge the <br />conditions for approval noted by the OSE. <br />20. As required by Rule 6.4.7(2)(a), the applicant has delineated the numerous water related features on and adjacent to <br />the affected land that may be affected by the mining operation. However, during the pre-operational inspection, <br />wetlands appear to occupy a larger percentage of the proposed mining area than that which is shown on the Pre- <br />Mining and Mining Plan Maps. In addition, the applicant states on page eighteen of the application that concurrence <br />of the delineation of wetlands by the U.S. Army Corps of Engineers (COE) is currently being sought and that should <br />the delineation of jurisdictional wetland boundaries change, adjustments to the application exhibits will be submitted <br />to the Division. Please provide an update as to the status of the COE concurrence of the applicant's mapping of <br />jurisdictional wetlands within or adjacent to the affected land. Irt addition, please provide a copy of any written <br />responses received from the COE verifying whether a 404, Nationwide, or other COE permit is needed for any of the <br />applicant's proposed activities. <br />21. In accordance with Rule 6.4.7(2)(b), the Division requests that the applicant identify and characterize the aquifer to be <br />mined in or through. The Division also requests that the applicant define or predict the cone of depression expected <br />for any areas to be dewatered. The cone of depression and assessment of other effects should define, at a minimum, <br />the horizontal and vertical extent of expected impacts. If during the assessment, the applicant determines that a <br />drawdown effect will occur offsite that may impact a current groundwater user, the applicant should explain any <br />mitigation measures to be implemented and trigger points that would cause mitigation measures to be put into effect. <br />The applicant will also need to establish a baseline for the current groundwater levels through at least five quarters of <br />ground water level measurements. <br />
