Mr. Bill Roberts <br />Adequacy Review, Pemtit Application No. M-2006-046 <br />August 1, 2006 <br />5. In accordance with Rule 6.4.3(e), please show the types of vegetation covering the affected lands. In particulaz, <br />please delineate the Cottonwood-dominated riparian area at the northeastern fringe of the permit area as described in <br />Exhibit J -Vegetation Information. <br />Rule 6.4.4 Exhibit D -Mining Plan <br />6. On page seven of the Mining Plan, the applicant states that no significant overburden covers the site, yet the applicant <br />indicates in numerous places throughout the Mining Plan that topsoil and overburden will be stripped and stockpiled <br />as needed. Please clarify if overburden will need to be stripped and stockpiled, and if so, identify the locations of <br />overburden stockpiles on Exhibit C-2: Mining Plan Map. <br />The applicant states that the operator will mine the property to create average slopes of 2.SH:1 V. However, the <br />applicant also states that the operator may mine to neaz vertical slopes if sufficient overburden is available for <br />backfilling of neaz vertical slopes. The Division recommends that the operator commit to mining to 2.SH:1V; <br />otherwise, the bond calculation will be have to be based on assuming neaz vertical slopes that have to be backfilled, <br />which will increase the required bond. Please respond. <br />8. In accordance with Rule 6.4.4(c), please describe how water draining from excavated material will be diverted and/or <br />impounded to protect against off-site impacts. <br />9. hi the Mining Plan, the applicant states that asphalt and concrete production may occur on site. If so, please describe <br />how the facilities will be managed to ensure ground water and surface water will not be impacted. Please describe the <br />nature and storage locations (if applicable) for all hazardous materials (including fuel) that will be used on site and the <br />measures used to contain them in the event of a spill or leak. <br />10. Please describe the construction of the cofferdam for the sump pit in Phase 1B, including the materials and installation <br />method. <br />11. Please inform the Division how the topsoiUoverburden screening berms will be protected from the mining operation. <br />If the pit is to be mined to neaz vertical slopes, the topsoil overburden berms may cause the mine slopes to become <br />unstable resulting in slope failure if an inadequate buffer distance is not established. The applicant has the following <br />options: <br />• Demonstrate the topsoiUoverburden screening berms will be stable under the proposed mining conditions <br />using a slope stability analysis; <br />• Maintain a setback distance of two times the depth of the pit and revise the maps to reflect this buffer or; <br />• Relocate the topsoiUoverburden screening berms to a more stable location, and revise the maps accordingly. <br />Rule 6.4.5 Exhibit E -Reclamation Plan <br />12. Rule 6.4.5(2)(f)(v) requires a description of the anticipated minimum depth or range of depths for those azeas where <br />topsoil will be replaced. The applicant has indicated that at least four inches of topsoil will be provided in the <br />reclamation condition however, the applicant should be aware that the Division requires a minimum depth of topsoil <br />replacement of six inches. Please commit to topsoil replacement of this minimum depth. <br />13. On page thirteen of the application, in the first paragraph under revegetation, the applicant commits to implementing <br />the recommendations of the NRCS with respect to revegetation of the site. However, in the second pazagraph under <br />revegetation, the applicant states that "The site will be seeded in the fall or at any time of year..." This statement <br />conflicts with the NRCS recommendations, which specify planting dates. Please clarify what time of year seeding <br />will take place. <br />
