<br />tive operations lave not appeared to have sttffere a loss in their
<br />market value because of their proximity to such ope ations, it appears
<br />L}.at such concerns over tl,e effect on property valt es of tl,e proposed
<br />operation are exaggerated and witi,out substantial basis; the actual
<br />impact, on property values of tk,e proposed opera on should not be
<br />significant.
<br />5. Impact on Quality of Life: Existing land tse patterns in t},e
<br />Animas Valley from Durango nortl, to Flermosa conY.ain mixture of single
<br />family residential, mobile Home parks, commercial, a well as extractive
<br />and related industrial activities. In tl,e immedia a vicinity of tl,e
<br />proposed sandpit is tl,e United Constntction wetlands extraction and fill
<br />operation, as well as t},e Val-Air Gliderport, in add tion to residential
<br />properties. Given tl~e character of tl,e existing 1 nd ttse patterns in
<br />t},e immediate vicinity and tl,e nature of tl,e pro sed operation, it.
<br />would appear that tl,e land use impacts associated wi ~ tl,e operation can
<br />be substantially mitigated provided that it is cond cted in tl,e manner
<br />set forth in tl,e application in accordance with tho a terms and condi-
<br />tions designed to mitigate such impacts.
<br />6. State Agency Approval: Given tl,e extrac ive nature of tl,e
<br />proposed land use, any County approval should be ex ressly conditional
<br />upon tl,e Applicant receiving and maintaining, at •11 times, Colorado
<br />Mined Land Reclamation Hoard appzoval, as well a all approvals or
<br />permits from relevant state agencies. Should such a provals or permits
<br />be suspended or revoked, sucl, action sl,ottld be st fficient cause for
<br />revocation or suspension of local land use approval.
<br />7. Enforcement: Since any approval of t}, proposed sandpit
<br />operation must be conditional upon tl,e operator's ompliance wit}, any
<br />terms and conditions which this Board attaches to such approval, in
<br />order for tl,e operation to be compatible with th surrounding area,
<br />provision s},ottld be made for tl,e enforcement o t},ose terms and
<br />conditions, including tl,e revocation or suspensio of such approval
<br />s},ould it be established to tl,e Board's satisfaction that t},e operation
<br />is not in compliance witl, any terms and conditions which the County may
<br />attach to sue}, approval.
