Any equipment or machinery p esent on tl.e site shall be promptly removed during periods of t~iq}, water o w},en flood danger is present.. There el~all not be any encroac}anents, fil s, stnictures, or substantial improvements located wit},in tl~e floodway of tl Animas River. 4. Periodic Review and Enforcement: This lan use approval is expressly contingent upon and subject to tl~e operator's receipt of and compliance with all required state permits or approvals, including, but not. limited to, tine permit for tl~e proposed operation require from the Colorado Mined Land Reclamation Board. Should tl,e Colorado Min Land Reclamation Board or any other state agency, whose permit. or approval s required for tt,e Sandpit operation, suspend or revoke stict~ permit or appr val for t}ie opera- tion, t}~e County's land use approval shall be deemed sttspe ded or revoked, as appropriate. Ttie operation of t}~e Sandpit shall be review ,d by this Board on a biannual basis to determine if tl,e operation is in ompliance with tl~e terms and conditions of County land use approval set fo t}~ in t}iis Resolu- tion. Sucl~ biannual review shall be }geld within tl~e ein ty (90) day period preceding such anniversary date, Any written allegations l~at ttie Sandpit is operating in violation of ttie terms and conditions of approval s},all be referred to the County planning staff for investigation. Tl~e County staff et~all promptly investigate any such written allegations c cerning violations and report tt,eir findings to t}~is Hoard.
