Section 780.16 (a) Continued. <br /> <br />white pelican use the Kerr Mine Area and the Kerr Tipple Area only <br />on a transitory basis, if at all, Kerr Coal does not plan to imple- <br />ment any special control or management measures designed to protect <br />them. Kerr Coal will visually monitor the areas to detect any <br />change in the pattern of use by these species. Similarly, based <br />upon the work of Propst (1980) on the Johnny darter, no special <br />control measures are required. <br />Because of the presence of an active golden eagle neat two miles <br />west of the Kerr Mine Area, Kerr Coal will undertake a periodic <br />monitoring program designed to collect data on the nesting activi- <br />ties of these birds and their wintering usage patterns. In addi- <br />tion, Kerr Coal will maintain close contact with the CDOW and the <br />USFWS so that it will be apprised of any recently identified possi- <br />ble adverse effects of mining activities on this species. <br />u <br />All species protected by State and Federal laws will be identified <br />whenever observed and the data compared with the data available <br />from CDOW and USFWS. Whenever species or habitat previously uni- <br />dentified is encountered, its presence will be immediately reported <br />to both the CDOW and the USFWS. <br />I • <br />(3) Habitats of unusually high value for fish and wildlife, such ae <br />wetlands, riparian areas, cliffs supporting raptors, areas offering <br />special shelter or protection, reproduction and nursery areas, and <br />wintering areas: <br />In the course of the consultation process required by 30 CFR 779.20 <br />(b) several areas in and around the vicinity of the permit area <br />were identified as having importance to wildlife.
