<br />Section 780.16 (a) Continued. <br />Revised 11/20/80 <br />Tipple Area; (2) the sage grouse wintering and breeding complex <br />associated with the Kerr Mine Area; and (3) the active golden eagle <br />nest located approximately two miles west of the Kerr Mine Area. <br />Since the golden eagle nest was previously discussed, only the <br />wetland and the sage grouse will be discussed below. <br />Wetlands. The area surrounding the Kerr Tipple Area has been iden- <br />tified as a wetland habitat. The integrity of the wetland sur- <br />rounding the Kerr Tipple Area will be protected through implementa- <br />tion of the sedimentation control measures outlined in Section <br />816.G5. Proper maintenance of the sedimentation pond at the tipple <br />will minimize the amount of suspended sediment leaving the Kerr <br />Tipple Area and thereby prevent degradation of the wetland habitat. <br />Implementation of the dust control measures described in Section <br />816.95 will serve to protect the adjacent aquatic habitats by <br />minimizing the build-up of coal dust. Noise control measures, in <br />conformity, with MSHA requlations, also will serve to minimize <br />impacts on the wetland habitat. <br />Management techniques to be used by Kerr Coal to protect and en- <br />hance the environmental values associated with the adjacent wetland <br />habitat will consist of cleaning diversion ditches and sedimenta- <br />tion ponds whenever their effectiveness might be impaired by sedi- <br />ment build-up. In addition, coal dust will be controlled by appli- <br />cation of a water spray whenever dust emissions become a problem. <br />1 <br />The exact importance of the Illinois and Canadian River as habitat <br />for the Johnny darter are unknown. Propst and Corrarino (1979) <br />documented the presence of the Johnny darter in the Canadian River <br />and Propst (1980) reported that the Johnny darter was present in <br />the Illinois River west of Walden. As was explained under Section <br />779-20 the Johnny darter has been placed on the Colorado <br />"threatened" list (Colorado Division of Wildlife 1978:18-20). <br />780-51 as <br />
