Section 780.16 (a) Continued. <br />• (1) Threatened or endangered species of plants or animals listed by the <br />Secretary under the Endangered Species Act of 1973, as amended (16 <br />U.S.C. Sec. 1531 et §~.) and their critical habitats; <br />Aa previously discussed in Section 779.20, the bald eagle and the <br />peregrine falcon are the federally listed threatened or endangered <br />species known to exist in North Park, but neither the Kerr Mine <br />Area nor the Kerr Tipple Area are critical habitat for either of <br />these two protected raptors. Furthermore, both of these species <br />utilize the proposed mining areas only occasionally, if at all. <br />I • <br />I • <br />The only impact control measure to be used in connection with bald <br />eagles and peregrine falcons, in addition to the general measures, <br />discussed in Section 780.16(b), will be in installation of special <br />raptor roosts on the Kerr Tipple Area powerline poles. (See: <br />Section 816.97). However, Kerr Coal will cooperate with the CDOW <br />and the USFWS in every way possible to insure that the mining <br />activities do not adversely affect these raptors. Finally, Kerr <br />Coal will visually monitor both the Kerr Mine Area and the Kerr <br />Tipple Area for the presence of either bald eagles or peregrine <br />falcons. <br />(2) Species such as eagles, migratory birds or other animals protected <br />by State or Federal law, and their habitats; or other species identified <br />through the consultation process pursuant to Section 779.20; or <br />As previously discussed in Section 779.20 and 780.16(a), in addi- <br />tion to the bald eagles and the peregrine falcon, three other <br />species protected by State or Federal law are known to exist in <br />North Park; namely, the greater sandhill crane, the white pelican <br />and the Johnny darter.
