Burden o[ Proof ReauiremeWs <br />The permittce has the butdm of proof whm seeking relief from total suspended solids (TSS), total iron and/or settleable solids <br />(SS) limitation. <br />Relief may be granted for each discharge occurrence only when necessary e~ shall not be granted when the permittae has <br />control over the discharge. The perminea should endeavor to meet the primary limitation whenever possible. The petmittce <br />will reed b show that exccedemce of the applicable limitation was caused by precipitation and no other source and that the <br />discharge wss beyond their control. All mental dewatering of the ponds shall meet TSS and total u~oo limitation. Pumping of <br />pit water is mt eligible for ehernete limitation. <br />a) For rainfall. b waive TSS end total iron limitation, it is necessary to prove that discharge occurrecl within 48 hours after <br />meaattable precipitation has stopped. In addition, b waive settleable solids limitation, it is necessary to prove that <br />discharge occurred within 48 hours after precipitation greater then the 10-year, 24-hour event bas stopped. <br />b) For snowmelt, b waive TSS and total iron limitation, it is necessary b prove that discharge occurred within 48 hours <br />after pond inflow has stopped. In addition, to waive settleable solitLs limitation, it is necessary to prove Wet discharge <br />occurred within 48 hours after pond inflow vohtme greater then the 10.year, 24-hour event has stopped. <br />Should a precipitation ovant ar srowmolt occur, the permittce shell submit adequate proof in order for en exemption to be <br />claimed. Said proof shall be submitted as an ettachmeat b the Discharge Monitoring Repoli (DMR) for the appropriate <br />period. The Division shell determine the adequacy of proof As part of [his determination, the Division shall evaluate whether <br />the pennittce court have controlled the discharge m such a ^~^~~ that primary limitation could have been met. <br />4. Past-Mining Areas <br />Commeaciog et the time active mining has ceased and surface areas have been rentrned to the required contour ell applicable <br />discharges may be ehgrbla for post-mining limitation. These post-mining ]imitation shell remain in effect until bond release. <br />The parmittce shall notify the Division upon cessation of active mining so that consideration of appropriate permit <br />modification can be made. <br />5. Best Management Practices -001.002. 005 <br />For the pH variance, as listed m PeR I.A.1. to be in effect, the permittce must be taking all reasonable measures to reduce the <br />pH, including the use of a COZ bubbler at the outfalls.
