ActRe WET TesYinc - OutfttLLs 001902.005. 009. 011. 013. 015. 016. 017. 019. 020. 021. and 023 (continued) <br />Any permince that is required to cottdutt a PTI/TIF. investigation shall do so in confo^^eMe with procedures identified in <br />the followwg documents, or as subsequently updated: 1) Methods for Aauazic Toxicity Identification Evahtations. Phase I <br />Toxicity Charaderiration Procedures, EPA/600/6-91/003 Feb. 91 and 2) Methods for Aquatic Tonicity Identification <br />Eyahyrv+ns. Phase II Toxicity Identifica[ion Procedures, EPA/600l3-88!035 Feb. 1989. <br />A thud Boatmen[ in this series is Methods for Aquatic Toxicity Identification Evahuuiogs. Phase ]II Toxicity Cortfinr~etion <br />Procedures, EPA/600/3-88/036 Fob. 1989. As indicated by the title, this procedure is intended to confirm thst the <br />suspected toxicant is truly the toxicant. This investigation is optional. <br />Within 90 days of the determinelian of the toxicant or m later than 210 days after demonstration of toxicity, whichever is <br />sooner, a wmrol program is to be developed and received by the Division. The program shell set down a method end <br />procedure for elimination of the Wxicity to acceptable levels. <br />(e) Rectors! For ReGet <br />The parmittce may request relief from further investigation and testing where the toxicant has not been determined and the <br />Division has determined suitable treatment does ml appear possible. in requesting such relief, the permittee shell submit <br />material sufficient to establish the following: <br />(i) It has complied with terms earl cmditions of the permit compliame schedule for the PTUTIE investigation and other <br />appropriate conditions ar may have been required by the Division; <br />(u) During the period of the toxicity incident it has been in compliance with all other permit conditions, imhuling, in the <br />case of a POTW, pretreatment requirements; <br />(ui) During the period of the toxicity imident it has properly maintained and opereted all facilities and systems of <br />traetmam o>id comrol; a~ <br />(iv) Despite the ciraimataaces descnbed in paragraphs (i) a~ (ui) above, the source and/or cause of toxicity could not be <br />located or resolved. <br />If deemed appropriate by the Division, the permit or the compliance schedule may be modified to revise the ongoing <br />monitoring and toxicity investigation regttirremeds to avoid m unproductive expenditure of the permittce's resources, <br />provided that fhe underlying abGgation to eliminate any continuing exceedeme of the toxicity limit shall remain. <br />(t) Soootaneotu Disaoorarance <br />if toxicity spontaneously disappears at any time after a test failure, the pemoittce shall notify the Division in writing within <br />14 days of a demonstration of dissppeengce of the toxicity. The Division may require the permittce to develop a~ <br />submit additional information which may imlude, bui is not limited to, the results of additio~l testing. If m panem of <br />toxicity is identified or recurring toxicity is not identified, the tonicity incident response is considered closed and mrmal <br />WET testing shall resume. <br />(g) Toxicity Reooener <br />This permit may be reopened and modified (following Proper administrative procedures) to include cew compliance dates, <br />additional or modified numerical permit limitations, a new or different mmpliame schedule, a change in the whole <br />effhieot tonicity testing protocol, or any other conditions related to the control of tonicaats if one or more of the following <br />events occur: <br />(i) Toxicity has bcen demonstrated m the effluent end the permit does mt contain a toxicity limitation. <br />Amendment No. 1 Issued MAY 30 1997 Effective JUL 1 1997 <br />Amendment No. 3 issued OCT 26 1998 Effective DEC 1 1998 <br />Amendment No. 4 issued Effective <br />
