Acute testa will ba replacement static teats of a single affluent grab sample. The permiaee shall
conduct each acute WET test is general accordance with methods descnbed in Methods for Meesurine the Acute Toxicirv
of Effluents and Receivine Waters to Freshwater and Marine Oreanisms, EPA/G00/4-90/027 or the most current edition,
except as modified by rho most current Division guidance document entitled Guidelines for Corsductute Whole Effluerrt
Toxicity Teats.
(b) Fmlttre of Test and Division Notification
Aa acorn WET test is fiilad wherovar the LCp, which represents an estimate of the effluent conceotrafion which is lethal
to 50% of the test organisms in the time period prescn'bad by the test, is found to be less than or equal to 100 °.b effluent.
The permittae must provide written notification of the failure of a WET test to the Division, along with a statemem as to
whether the Preliminary Toxicity Incident ('PT[')lfoxicity Identification Evaluation ('TIE") investigation or accelerated
testirrg is being performed (see next section). Notification must be received by the Division within 14 calendar days of
the demonstration of ttctQe WET in the routine required test. 'Demonstration' for tbe purpose:: of Parts
I.A,2.(b),(c),(d) end (f) trams no later than the fast day of the laboratory test.
(c) Automatic Compliance Schedule Upon Failure of Test
If a rattiae acute WET test is failed, the following automatic compliance schedule shall apply. As pert of this the
perooittee shall either:
(i) proceed to conduct the PTI/TfE investigation as descnbed in Part I.A.2.(d), or
(it) conduct accelerated testing using the single species found to be mom sensitive.
If accelerated testittg is being performed, the permittee shall provide written notification of tite results within 14
calendar days of completion of the "Pattern of Toxicity"1"No Toxicity" demonstration. Testigg will be at least once
every two weeks for up to five tests until 1) two consecutive tests fail or thrx of five tests fail, in which case a pettem of
toxicity has bean demonstrated or, 2) two coasecutiva tests pass or three of five tests psss, in which case m pettem of
toxicity has bcea found. Tf m pettem of toxicity u formd the toxicity episode is considered to be eroded and routine testing
is to resume. If a pettem of toxicity is fo[md, a PTUTIE investigation is to be performed. If a pen.em of toxicity is not
demonstrated but a significant love] of erratic toxicity is fotmd, the Division may require m increa:~ed frequency of routine
monitoring or some other modified approach.
(d) PTI/I'~
The parmittee may use the time for mvosligatioa to conduct a PTI or trove directly into the TIE. A PTI consists of a brief
search for possible sources of WET, which might reveal Ca„Qes of such toxicity end appropriate ariractive actions more
simply and cost effxtively thm a formal TIE. If the PTI allows resolution of the WET incident, the TIE need not
necessarily be conducted. If, however, WET is not identified or resolved during the PTI, the TIE must be condrcted
within the allowed 120 day timo frame.
• Except outfall 002 -see Part I.B.1.6).
